We Must Be Kept Safe From Joe Robertson!


I first met Joe Robertson last summer while in Lincoln Montana. I had just been officially brought on as Media Director of the Oath Keepers, and was there working on some of the stories for the White Hope Mine operation. As is often the case, when someone finds that you are with the Oath Keepers, they tend to start to relay to you their own hardships and trials with the powers that be. In Joe’s case, it was with the Forest Service and the EPA. Joe is 77-year-old white haired, disabled, combat veteran who with all that he is going through always seems to greet you with a smile. We hit it off right away, he seemed like a long lost elderly uncle that you finally met later in life that fast become your favorite. There in Lincoln, at the Three Bears Motel, Joe found we Oath Keepers in one of the rooms that we were currently using as an impromptu media center. Joe came in and introduced himself, telling us that they were up in the area to help with the wildfires that were raging across the valley. Joe and his wife of 30+ years were too busy to really tell us their story, and at the time, they had no idea just how bad things would get as they were feeling confident that justice would prevail after hanging a jury in their first trial. Little did he know, at the time, the Federal Courts would be relentless in their pursuit.


So what crime had this obvious criminal mastermind, who was skillfully masquerading as a veteran volunteer firefighter, perpetrated upon the unsuspecting citizenry. What heinous danger was he bringing into their small mountain community, that would bring a Federal Judge out of retirement just to make sure that Joe spent, possibly, the rest of his life in prison, or at least lose his property, due to fines no average American could ever hope to pay? What vile act of terrorism did this man unleash?


Joe and his wife had put three small ponds onto their property. Ponds that they would use for the evil, vile purposes of watering their animals and fighting wild fires in their community. They also improved a road leading up to their property which includes 200 acres and an unpatented mining claim.


Let me try and cut out my sarcasm, but it can be so hard to keep hearing horror story after horror story of some old man or woman out in the woods being thrown off their own land and losing everything due to what can only honestly be described as a federal land and power grab. As we see family after family be put off their land, we must expect to see events like Bundy Ranch, Sugar Pine Mine, White Hope Mine, and the Malheur Occupation become the norm. As with any social cycle of a growing abuse by the powers that be, we must expect to see a push back by the people who are everyday, becoming more and more desperate, to hold onto the last remaining scraps of the once great American Dream.


Joe and his wife have tried to live a simple life, being self-reliant and steadfast like the pioneers and miners that over 200 years ago started to build a life in South Western Montana. They generate their own electricity and raise a few animals. Joe also tries to help out his fellow veterans by allowing the use of his property by the Helena Veterans Support Unit. HVS helps his fellow vets to overcome PTSD and other combat related issues by organizing, hiking, sweat lodges, camping, and hunting on his property.


When they decided to put in ponds for their animals, and to use with their wild firefighting business they asked what permits they might need. They received a 310 permits and the rights to use the pond water from the DNRC (Department of Natural Resources and Conservation in Montana.) Joe and his wife believed they had done all they needed to.


That did not stop the EPA from charging Joe with two counts of depositing dredge materials into the United States water ways and one count of Depredation of Forest Service property. This is not the first time the Joe has faced these charges. The first time resulted in a hung jury, which Joe accredits to being lucky enough to have a few fellow veterans on the jury. The second time around he was not so lucky. Not only did his own public defender threaten to resign if he pushed the issue of bringing in an expert witness that wasn’t one of the EPA’s “experts.” As a matter of fact, Joe had an expert witness that completely blew away the whole federal narrative. This wasn’t coming from just anyone, it was coming from Ray Kagel of Kagel Environmental LLC Whose pedigree in the filed of Geological Survey is way to lengthy to go into but follow the link here. It should suffice to say that he took on the EPA going all the way to the Supreme Court and he won. But what Kagel Environmental had found was nothing new, before them there was yet another Survey done by Geolex out of Helena that found the same result. Both of these witnesses were barred from the court room according to Joe.


There is also a very disturbing story relayed to me by Joe that also has me wondering just how much stranger reality is than fiction. This story involves two Forest Service Law Enforcement Agents that were caught by witness and trail cam trespassing and what looks to be fabricating evidence. Approximately a week after Joe’s first trial resulted in a mistrial, he has summoned to by his public defender. While away from his property, Agents of the EPA were caught, on camera, removing some hosing from Joe’s fire truck and creating a drainage to down the canyon and into a tributary Cataract Creek which they videoed as “evidence.” They were caught by Joe, his neighbors, and trail cam. Yet, in an Ex-Parte hearing Judge Malloy did not find this as an attempt to manufacture evidence and it had no bearing on the case.


As we see so very often these days, there is so little resembling justice in our court systems. It seems the average “Joe” can never get a fair shake. So now Joe has been convicted, and could face the rest of his life behind bars and lose his home of over forty years. The EPA who literally poisoned the Animus River in Colorado is turning it day-glow yellow and got off scott-free (well I am willing to bet someone got a promotion in the end,) and now Joe Robertson and his wife stand to lose everything. I am not sure what we can do at this point. I would encourage everyone to try and make it to his sentencing this upcoming Wednesday July 20th in Missoula, please be professional and peaceful as we stand with Joe, and let our voices be heard that we see this and expect those who are entrusted with the safe guarding of Liberty and Justice to do their jobs with integrity and honor.   1. Where is Judicial Watch on this? This trial was so tainted there should have been a mistrial and a new judge appointed.

Went back and reread the US Constitution – the supreme LAW of this land that ALL laws must follow (be in Pursuance thereof) to see where there is any delegated authority to create an agency such as the EPA. There isn’t. (A lot of federal agencies were created that those who serve within the federal government have NO LAWFUL AUTHORITY to create.)

    This is going to be hard to understand entirely because our justice system within the states and federal governments are so off track and actually have no lawful authority over the American people. Anyone willing to try using OUR SUPREME LAW? Also, and the judge(s) the part of the US Constitution from which they get their delegated authority from, and under what conditions they are *ALLOWED to remain in office for life – because I can tell you they were NOT taught American law in any American college.

    *The US Constitution delegates duties to those who serve within the judicial branch that covers those that serve with each states judicial branch; it is in writing. It requires from them that they take and KEEP the required Oath, and that they do the duties as constitutionally assigned to that branch/position. It is not a long list that they have to meet in order to keep that position for life, but they are REQUIRED to do those things.

    Why are we not discussing and bringing out into the open exactly what those who serve within our governments are allowed to do, instead of letting them, their agencies dictate what is said, hence, what is believed by the dumbed down, propagandized populace? Or is the US Constitution dead, that we cannot start simply doing those things it requires of US, “WE THE PEOPLE of the united States” who have bothered to learn those things? There are even court decisions that back those up.

    St John Tucker: “The congress of the United States possesses no power to regulate, or interfere with the domestic concerns, or police of any state: it belongs not to them to establish any rules respecting the rights of property; nor will the constitution permit any prohibition of arms to the people;…”

    Mack/Printz v USA (1997), areas within the States into which the General government may not properly intrude or incur, and there are areas in the General government into which the States may not intrude or incur. Here is a portion of Scalia’s statement:

    “It is incontestable that the Constitution established a system of “dual sovereignty”…. Although the States surrendered many of their powers to the new Federal Government, they retained “a residuary and inviolable sovereignty”…. Residual state sovereignty was also implicit, of course, in the Constitution’s conferral upon Congress of not all governmental powers, but only discrete, enumerated ones. Article 1, Section 8, which implication was rendered express by the Tenth Amendment’s assertion that “[t]he powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people”. The Framers’ experience under the Articles of Confederation had persuaded them that using the States as the instruments of federal governance was both ineffectual and provocative of federal state conflict. The Framers rejected the concept of a central government that would act upon and through the States, and instead designed a system in which the state and federal governments would exercise concurrent authority over the people. The great innovation of this design was that our citizens would have two political capacities, one state and one federal, each protected from incursion by the other” – “a legal system unprecedented in form and design, establishing two orders of government, each with its own direct relationship, its own privity, its own set of mutual rights and obligations to the people who sustain it and are governed by it.”… The Constitution thus contemplates that a State’s government will represent and remain accountable to its own citizens. As Madison expressed it: “[T]he local or municipal authorities form distinct and independent portions of the supremacy, no more subject, within their respective spheres, to the general authority than the general authority is subject to them, within its own sphere.” ….This separation of the two spheres is one of the Constitution’s structural protections of liberty.”

    (1) Federalism has more than one dynamic. In allocating powers between the States and National Government, federalism “ ‘secures to citizens the liberties that derive from the diffusion of sovereign power,’ ” New York v. United States, 505 U. S. 144, 181. It enables States to enact positive law in response to the initiative of those who seek a voice in shaping the destiny of their own times, and it protects the liberty of all persons within a State by ensuring that law enacted in excess of delegated governmental power cannot direct or control their actions.
    See Gregory v. Ashcroft, 501 U. S. 452, 458. Federalism’s limitations are not therefore a matter of rights belonging only to the States. In a proper case, a litigant may challenge a law as enacted in contravention of federalism, just as injured individuals may challenge actions that transgress, e.g., separation-of-powers limitations, see, e.g., INS v. Chadha, 462 U. S. 919. The claim need not depend on the vicarious assertion of a State’s constitutional interests, even if those interests are also implicated. Pp. 8–12. Cite as: 564 U.     Thomas Jefferson: “The several States composing, the United States of America, are not united on the principle of unlimited submission to their general government; but that, by a compact under the style and title of a Constitution for the United States, and of amendments thereto, they constituted a general government for special purposes — delegated to that government certain definite powers, reserving, each State to itself, the residuary mass of right to their own self-government; and that whensoever the general government assumes undelegated powers, its acts are unauthoritative, void, and of no force: that to this compact each State acceded as a State, and is an integral part, its co-States forming, as to itself, the other party: that the government created by this compact was not made the exclusive or final judge of the extent of the powers delegated to itself; since that would have made its discretion, and not the Constitution, the measure of its powers; but that, as in all other cases of compact among powers having no common judge, each party (the people) has an equal right to judge for itself, as well of infractions as of the mode and measure of redress.”

    Hamilton, Federalist 33: “But it will not follow from this doctrine [that laws passed by Congress are the Supreme law of the land] that acts of the large society which are NOT PURSUANT to its constitutional powers, but which are invasions of the residuary authorities of the smaller societies, will become the supreme law of the land. These will be merely acts of usurpation, and will deserve to be treated as such.”

    Consider Emer de Vattel’s Law of Nations: “The constitution and laws of a state are the basis of the public tranquillity, the firmest support of political authority, and a security for the liberty of the citizens. But this constitution is a vain phantom, and the best laws are useless, if they be not religiously observed: the nation ought then to watch very attentively, in order to render them equally respected by those who govern, and by the people destined to obey. To attack the constitution of the state, and to violate its laws, is a capital crime against society; and if those guilty of it are invested with authority, they add to this crime a perfidious abuse of the power with which they are entrusted. The nation ought constantly to repress them with its utmost vigor and vigilance, as the importance of the case requires.”

    “Constitution of this state declares, among inalienable rights of each citizen, that of acquiring, possessing and protecting property. This is one of primary objects of government, is guaranteed by constitution, and cannot be impaired by legislation.” Billings v. Hall (1857), 7 C. 1.

    “Right of protecting property, declared inalienable by constitution, is not mere right to protect it by individual force, but right to protect it by law of land, and force of body politic.” Billings v. Hall (1857), 7 C. 1.

    “Right to possess and protect property is not more clearly protected by constitution, than right to acquire it. Right to acquire is right to use proper means to attain end; and use of such means, cannot be prohibited by legislature, except peace and safety of state require it.” In Re Newman (1858), 9 C. 502.

    “As general rule men have natural right to do anything which their inclinations may suggest, if it be not evil in itself, and in no way impairs the rights of others.” In Re Newman (1858), 9 C. 502.

    “The constitution of a state is the fundamental law of the State.” Ware v. Hylton, 3 Dall. 199.

    “What is a constitution? It is the form of government, delineated by the mighty hand of the people, in which certain first principles of fundamental laws are established.” Van Horne v. Dorrance, 2 Dall. 304.

    “Constitutional provisions and amendments to the Constitution relate to the fundamental law and certain fixed principles upon which governments are founded. Constitutions are commonly called the organic law of a State.” State ex rel. Halliburton v. Roach, 230 Mo. 408, 130 S. W. 689.

    “A constitution is designated as a supreme enactment, a fundamental act of legislation by the people of the state. A constitution is legislation direct from the people acting in their sovereign capacity, while a statute is legislation from their representatives, subject to limitations prescribed by the superior authority.” Ellingham v. Dye, 231 U. S. 250.

    “The basic purpose of a written constitution has a two-fold aspect, first securing [not granting] to the people of certain unchangeable rights and remedies, and second, the curtailment of unrestricted governmental activity within certain defined spheres.” Du Pont v. Du Pont, 85 A 724.

    “The constitution of a state is stable and permanent, not to be worked upon the temper of the times, not to rise and fall with the tide of events. Notwithstanding the competition of opposing interests, and the violence of contending parties, it remains firm and immoveable, as a mountain amidst the strife and storms, or a rock in the ocean amidst the raging of the waves.” Vanhorne v. Dorrance, supra.

    “We are bound to interpret the Constitution in the light of the law as it existed at the time it was adopted.” Mattox v. United States, 156 U. S. 237, 243.

    “To say that one may not defend his own property is usurpation of power by legislature.” O’Connell v. Judnich (1925), 71 C.A.386, 235 P. 664.

    “Owner has constitutional right to use and enjoyment of his property.” Simpson v. Los Angeles (1935), 4 C.2d 60, 47 P.2d 474.

    “Wherever right to own property is recognized in free government, practically all other rights become worthless if government possesses uncontrollable power over property of citizen.” House v. Los Angeles County Flood Control District (1944), 25 C.2d 384, 153 P.2d 950.

    “Constitutional guarantee securing to every person right of acquiring, possessing, and protecting property refers to right to possess absolutely and unqualifiedly every species of property recognized by law and all rights incidental thereto, including right to dispose of such property in such manner as he pleases.” People v. Davenport (1937), 21 C.A. 292, 69 P.2d 396.

    CRUDEN v NEALE, 2 N.C. 338 (1796) 2 S.E. 70.: “Corporate administrative rules, regulations, and legislation do not apply to non-corporate natural men and women who stand in Common Law and in full legal capacity as one of the sovereign people.  The law states: “There, every man is independent of all laws, except those prescribed by nature. He is not bound by any institutions formed by his fellowmen without his consent.”

    “Right of property antedates all constitutions. Every person has right to enjoy his property and improve it according to his own desires in any way consistent with rights of others.” People v. Holder (1921), 53 C.A. 45, 199 P. 832.

    BTW, did anyone else hear of, and read, the latest find of Thomas Jefferson – a letter?

    1. As I have said before cal the constitution is very much dead. It is dead because the (Appointed) government doesn’t abide by it. I say appointed because it is. We use electronic voting machines which mean no paper trail and no way to see if a rigging of the election has occurred. I’ve done my own personal street corner survey in Syracuse my and rest assured Hillary is not winning in that very liberal city. Not voting was the most common answer I got because most were voting Bernie. I personally don’t vote because I need no representatives to represent me. I don’t have faith or belief in “authority” because man was not born to serve a master or group of masters. I do note believe in the constitution either simplify because paper proclamations mean nothing to those unwilling to abide by them. I serve only to my family, because the rest of you are not my responsibility. Your government was given too much power, too long ago. The federal reserve act was a dictatorial act formed in secret, and yet you abide by it. 70% of the voting body stayed home for Obama’s mid term, which means they are not duly elected by “the people”. And don’t get me started on “the people” because that is a broad statement with no real meaning considering I could mean anyone or a small group say maybe the “super delegates” which have more voting power than the entire country. That’s another thing people don’t understand, if the entire nation were to vote for one man or woman the delegates can vote for someone else and that someone else will be president. You vote really doesn’t matter. Congressional voting records will show this when it comes to laws as well.

  3. I’ve never understood why our veterans take a backseat to just about everyone else in this “great” country of ours. We glamorize B. Jenner and salute his/her bravery at becoming a she-male, but the men and women who have fought and died for our freedom rarely get a glance. It’s a disgrace. It starts at home. Parents, forget about gay marriage and 3rd bathrooms. Teach your children well; that should always include your expectation that they will honor, respect, and hold dear the veterans of our country, and those who continue to serve in the most honorable of professions. Consider it a duty, and expect as much from your children. For a lot of adults, it’s too late; but there’s no reason why the next generations shouldn’t be out veterans’ best friends.

  4. Hopefully if everything goes as planned and Donald Trump is elected, in January a new Head of the EPA will be appointed. Then, many of the ass holes that unduly harass people will be fired. EPA needs to focus on the large Corporations and Companies who intentionally pollute our country with their waste products.

    1. I doubt every much that the guy who exemplifies big business and corporate involvement in politics is going to take any efforts that could in any way hurt large corporations and companies.

  5. Why is everyone waiting for somebody else to fix everything (as in Trump). The buck stops with you! If you want it to happen then you need to help make it happen! Step forward and you walk with history, sit back and you will be counting the grains of sand as they pass you by!

    1. It is past time to be proactive and take the bull by the horns. Become active in any way your conscience dictates to recover the stolen freedom and our right to Life, Liberty and the pursuit of Happiness.

  6. There is no consequence against these evil perpetrators in this country for their illegal agency dictators and unconstitutional judges destroying the lives of good Americans. The sheriff needs to be called out to protect his man and family. Back the sheriff up with hundreds of armed citizens.

    Just like many other great western states, the state of Montana has become the play ground for the wealthy elite, purchased the leadership; conforming to the NWO agendas.

  9. This agency is a mirage. It relies on secret databases which are not allowed to be accessed by independent scientific authorities. It has a revolving door with militant environmentalists and not for profits with shadowy financing. You are under no obligation to believe any proclamation from this agency. It must be shut down. It does not represent science. It is a political tool you must resist!!

  10. I’m in Montana and I’ll be there to see what happens. This is such B.S. but looks like a common theme now days as I too am facing a F.S. land grab. What is a person to do, when the rule of law goes out the window. So sad, we have lost the Republic and on a collision course with despotism.

Let us wear the Bundy Families shoes and feel their pain. let us shed their tears …. Let us endure the sleepless nights of the Finicum family….. Let us We the PATRIOTS feel the fear of the Hammond family and so many others!!!!!!!.
    let us face the reality of the what if Cliven was my dad your dad! what if Mr. Robertson was your Dad. and Ammon and ryan and dave Bundy was my brother , or rather your brother. And mrs. Finicum and Mrs Bundy, Mrs. Hammond, Mrs. Robertson was our Moms and our family. Would it then change anything ? the reason i ask is simply this. how many HOW MANY MORE great Americans have to go through this craziness and live in fear everyday. How many more nights do they have to lose sleep because they feel like they have been abandoned by a once strong Patriot community. folks we are not the ones losing our homes our land our LOVED ONES . believe me when i say it will come to us and our loved ones as well. but because we are not literally in their shoes so many of us say not now , nows not the time we must wait. i say this if Mr. Robertson was my Father or my Uncle he would NOT be going to jail at all. specially if he asked for help. i want to apologize a head of time to all the future Families in this country that will soon enough be in the shoes of the great families I’ve already listed. I’m sorry we haven’t stopped this madness and this tyrannical behavior. I’m sorry that one day soon it will find its self upon your door step and you to will then walk in the shoes of these great families. you and maybe even my family will feel the pain of dads being locked away forever. the pain of sleepless nights . the tears and the gut wrenching tears that come along with losing the homes the land the loved ones to corruption. I’m sorry we haven’t stopped it. Im sorry your children my children will grow old in a once great Nation that had the courage of great warriors in days past. i sorry we let you down. but until we are willing to sacrifice EVERYTHING we will continue to lose EVERYTHING!!!!!. One of the greatest Navy SEALS ever ( I BELIEVE ) to step foot on the battlefield ( JOCKO ) made a very clear statement You must be willing to die and you must be willing to kill. and if you truly are 100% willing to kill and willing to die then victory will be achieved. but if you are not willing to kill and you are not willing to die then you’ve already lost. folks our parents living their last years in freedom and our children living their years to come with true freedom……ISNT THAT WORTH everything… how did we lose the courage to stand ….talking and complaining only gets us so far.specially when great men and woman are dying and being locked away. one last thing saturday we had a mens conference at our church and all i could do was think about the bundys ,,Cooper, Santelli, Parker and all the others who sacrificed so much including being with their wives and kiddos. i worshipped God on your behalves and i prayed for all of you. I’m sorry brothers we let you down and allowed you to be taken from us and your families….may God give you and your families the strength to hold fast in this dark hour… Dave Bundys wife if you some how see this .     1. I soooo agree with your posting!! We keep hearing that violence is not the answer. So does that make our original Revolutionary War wrong??? When you and I do something perceived as illegal the forces of government show up willing to commit violence on their behalf. Yet we are told over and over that we must always be peaceful. Bull$h!t!!!! The government brings the fear of death with them wherever they are found. I believe that all of the ‘peaceful’ rantings do nothing because there is no element of fear attached. Others and not your average patriotic American have brought this plague of tyranny upon us. We must stand resolute and willing to bring whatever force is necessary to crush today’s tyranny!

  12. stock ponds and life in prison. mean while Saudi Arabia’s biggest dairy company can go into Blythe California and Vicksburg Arizona and pump tens and hundreds of thousands of gallons of water and ship it with the alfalfa back to saudi Arabia because they have NO NO NO water but they can pump ours and take it back to the middle east. meanwhile American families can’t build an out house on their land or even fart in the wind without being considered terrorists …. well when we run out of water in the great lakes and so many other places i guess the ones that gave the ok for foreign countries to take our water supply will be thirsty to.

  14. No government corporation has ever been delegated authority over the people. They can’t be delegated this authority because the people that created the corporation only had authority over themselves. You can’t give, what you don’t have. Here’s the way I see “law.” There is no law, except God’s law. There are only contracts. All presentments are an offer to contract. The offered contract should be rejected within
    72 hours of receipt. They have no lawful authority to prosecute the living people in their corporation court, unless they trick us into consenting. How do we consent? By showing up in court, entering a plea, hiring an attorney, failing to reject the offered contract, etc. They take advantage of our ignorance of the workings of their con game. Do your research now, before you have a problem. The gov. agencies and courts will claim jurisdiction if we use two letters and a zip code in our mail location.
    Spell out the state name, and omit the zip code, the mail will still arrive. Yes, I know, when ordering merchandise, we are usually forced to use a zip code. Don’t take my word for anything, do your own research.

The Media ignores these incidents that are occurring regularly, this is the News the people of this country should be hearing, not the dribble being fed to us called “news”.   17. I think this article is pure emotional BS. No real facts were given, just emotion. How can I support this? How can Oath Keepers support this on such limited info. Just because he is an old vet means nothing. So am I. So What? This does not bode well for Oath Keepers just jumping into every fray.

    1. I agree. I need to do a little research on my own when it comes to this. There are usually two sides to the arguments, and I believe we are not getting the whole story.

      1. I agree…. I’ve been looking for some mention of what Joe DID or was accused of, besides dumping some material on land.
        Did he own the land or was he a squatter with fewer ‘property rights’ than are implied or inferred?
        Usually, a good article starts with something like, “accused of…” along with other details that might help a reader understand why the judgment was ‘fair’ or not…

I CAN ALMOST GUARANTEE THAT WHEN TRUMP IS ELECTED , THE EPA WILL NO LONGER be pulling this kind of shit , especially in reference to home owners and ranch owners in the West . The FBI have no authority involving themselves in the states , the instance when they murdered one of the men fighting for the freedom of the ranchers in Oregon. On his way to a meeting in the community stopped by the Buteau of Land Management and the FBI after getting out of his vechilcel he was murdered in cold blood all on a video as proof that they FBI murdered him . That is the Justice we need to bring to this country , not rogue murdering government employees pushed to their limit by this Corrupt Obama Adaminsitration. We need to bring this country together once again .

I have neither seen, nor heard ANYTHING as of yet to even suggest that donnie dRumpf is going to rein in the EPA, the VA, the Forest Service, the federal BLM (not to be confused with the radical racial activist shill group of the same acronym) or any other particular FedGov bureaucracy, except some recent mumbled nonspecifics about the IRS, and a “hopefully major, major tax cut”.

    Trump’s own history shows multiple examples of his efforts to abuse the rights of individual private landowners to acquire THEIR property for HIS development & profitable use. When sugar won’t get him his way, he has sent out legal teams and negotiators to bargain, threaten, intimidate…whatever necessary to get that chunk of land for his corporation, to tear down granny’s home and build an opulent limo parking garage with the Trump name and logo on it. Failing those tactics, and the smear campaigns against the property owners that have always followed – Trump has tried to use the courts and the power of eminent domain to get his way – sometimes successfully, sometimes not.

    Therefore, it literally flies in the face of the facts & common sense to think that Donald will suddenly change his longstanding ways. In short, you cannot possibly “guarantee” Trump will do anything except what suits him in the moment. He also cannot possibly “make America Great Again” He is not capable, it is up to us, the American people…!

I don’t necessarily agree with the sentence; however, after reading the court documents, he had used an excavator to dig on US National Forest to create these ponds and tap into Federal Water Streams which Fish and other Wildlife used. He was also doing this on someone else’s private property without their consent. He started this in 2014. When he was told to stop, they found that he continued to do this. He is also not some poor country boy. He owns mines which he was using these water supplies for. He definitely broke the law. Rule of Law is not thrown away just because someone else did it. If that were the case, all murder cases should be dropped. I think a hefty fine would suffice. 15 years in prison (which I doubt they will give him) seems excessive.

  21. All this “peaceful standing with someone, in this case Joe, is a bunch of wasted time and effort. What good does stating our displeasure with the fed gov’s overreaching, gestapo actions do anyway? We all stand up and cry like little babies as the fed gov’s illegal, immoral agents continue to do anything they want, anytime they want, anywhere they want. By the time Oath Keepers or any other talking heads figure out the only real solution to the fed gov, it will be too late and we will all be crying together in modern concentration camps or prisons. Keep talking everyone, because that is EXACTLY what the fed gov is counting on.

  22. As a former wetland science consultant, I have seen similar cases in New England, where the landowners received their local permits, not knowing about any requirements for federal permits. In both cases that come to mind, the landowners (one a lifetime military man and the other a dairy farmer) suffered greatly due to the bullying to which they were subjected. One actually died of a heart attack as the process unfolded.

    I don’t want to bore anyone with my opinions about the workings of the EPA and the ACOE. Suffice to say that I believe ALL regulatory authority should be stripped from the EPA and turned over to the states, and that the ACOE should stick to dealing with navigable waterways that are important for national defense or interstate commerce. Again, just my humble opinion.

  23. My opinion, after meeting Joe in Lincoln last summer, is the his whole problem is due to the fraud of the whole court system calling itself the federal courts. They are administrative for the corporate tribunal and have NO JURISDICTION to do what they are doing to American Nationals who are living peacefully on their own land. JUDICIAL TYRANNY is the main problem.
    There is no chance to get any justice in a court system rigged for the corporation calling itself our Federal Government. They are NOT. They are a private, mostly foreign owned for profit governmental services corporation operating in Admiralty and Maritime jurisdiction and can not even speak to an American State National. The UNITED STATES is NOT America.

  24. The judge, the prosecutor, the court appointed “attorney”, the EPA personnel, the Forest Service personnel, all draw a government paycheque from the same boss. Government will never move to limit its assumed authority over we the people. And government will not, as recently demonstrated, refrain from using deadly force to accomplish its goals and remind we the people that it can do anything it wishes to us and there’s damn little that we can do about it. “Reasonable” regulations and “due process” are what the government says they are.

  25. If the facts matter- a grand jury agreed with prosecutors on this case that this misguided man not only altered his property, affecting others and the water ways, without following procedures. Even if you find that acceptable the evidence also indicated he dug on private property that was not his as well as federal property- ours- not his. He did this after being repeatedly warned. The Oathkeepers support this? Get the facts before you all start using the gov overreach argument or the poor veteran defense. This guy has issues and thought he could do as he pleases on and impacting property that is not his.

    1. Well, yes, of course. We must “get the facts”. So let’s start with you bringing forth the proof of your statement about Joe digging on someone else’s private property. Whose private property did he dig on?
      I am not the expert here, but I think that why Oath Keepers is concerned with Joe’s plight is because the court totally ignored the report which indicates his ponds caused no ill effect on any aqua-eco system, and Joe’s appointed “defender” did not even introduce that report to the court. I think Joe has been railroaded.
      And btw, if you’re so concerned about “our” public property, what say we look more closely into the Federal government’s bogus claim that it somehow is authorized to “manage public lands” inside the boundaries of any State, yes? Put the damned federal government back into its 10-mile box called Washington D.C. and keep it out of our States — let the States manage their public properties and boot the feds off our lands. What do you think of that idea?
