You might remember that Andy Johnson, the rancher from Wyoming, just won his case this week against the Environmental Protection Agency (EPA).

That battle concerned their environmentally friendly stock pond on their private property. The EPA demanded that he remove the pond and threatened him with fines of $37,500 per day if he did not comply. The case was settled this week and the Johnson Family are happy.

However…

He is not the only citizen that the EPA has targeted. More cases are coming to light on the extreme overreach of this organization.

Joe Robertson w Shasha May 2016Disabled Navy veteran Joseph Robertson, 77, of Basin, Montana, and his wife, Carri, own about 200 acres of beautiful Montana mountain land. They homestead the White Pine Lode patented mining claim that he owns, and live “green” as Robertson is quick to explain. “I’ve worked over 30 years for mining corporations and I know what contamination is.”

They lease a portion of it to the Helena Veteran’s Support group. They offer camping, hiking and more to veterans and their families. “There is a great veteran support group here,” Robertson tells Redoubt News.

They, also, own a large Freight-liner water tender that they loan to the volunteer fire department, and share with their neighbors. Additionally, they have an outfitted fire truck, including foam, hose reels, etc. that they use with the volunteer fire department.

They love their community and are active in helping, and sharing with, their neighbors.

Due to multiple fires in the area over the past several years, Robertson has maintained and improved his property by building stock ponds for his animals and fire prevention for his and the neighbor properties.

But, he has also scrapped with the government, by way of the Forest Service and the EPA, for years. The harassment by the government began over a decade ago, complaining that he was not allowed to repair the road that leads to his private property. This came to a head in 2013 when they charged this disabled veteran for violation of the Clean Water Act.

The government contends that nine stock ponds affect approximately one-tenth (1/10) of an acre of discharged pollutants into the Jefferson River, nearly 60 miles away.

The first trial was held last year and ended in a hung jury. It would probably have concluded in favor of Mr. Robertson had the federal defender presented all of the evidence. Yet, the defense, Michael Donahoe, refused to call any expert witnesses.

The Director of Veterans Affairs for Senator Steve Daines, Denny Lenoir, was in the courtroom during the trial. Donahoe seemed upset when Robertson would consult with Lenoir. “Why are you making this political?” he complained.

Donahoe’s group had paid for, and received, an environmental impact report detailing how Robertson did NOT violate the law, yet he treated it as if it was not accurate. This report outlines the fact that there is no stream from the Robertson pond to any tributary. Donahoe’s response was that the EPA was the expert testimony, and he would rely on their report.

Donahoe has a good bio with criminal defense. Why would he choose not to use his own expert witness, and report? He chose instead to claim the EPA was the only expert testimony needed in this case.

There is a second, nearly identical report, completed by Kagel Environmental, LLC, included here. Documented by Ray Kagel, a former federal regulator, he shows that Robertson actually improved the land and could not have contaminated any US waters.

The report outlines that the alleged wetlands “is not waters of the U.S.” and it is virtually impossible for them have a “significant effect on the physical, chemical, and biological integrity of the Jefferson River.”

Kagel spoke with Robertson’s public defender, offering to testify on Robertson’s behalf. Donahoe declined the offer and stated he did not wish to use any expert testimony. Kagel completed the report, pro-bono, for the Robertson’s anyway. Thank you Ray Kagel!

Judge Donald W. Molloy retired in 2011. Molloy was the subject of a complaint letter by Robertson some years ago, so it is surprising that, knowing there is bad blood between them, he came out of retirement specifically to hear this case. However, seeing the way this case was handled, maybe it is not so surprising after all.

A week after the first trial ended in a hung jury, Donahoe asked the Robertsons to travel to his office in Helena. Upon the return to their home, they caught two EPA agents attempting to drain their pond, trying to make a stream flow a mile down the canyon to Cataract Creek. It was a blatant attempt to manufacture evidence to support the government case. The timing does seem suspect, as they do not travel off of their property often. It just so happened that they were called away, by their attorney, during this event.

When this information was brought to the attention of Judge Molloy, the Judge did not see a problem with this manufactured evidence. In fact, this ‘evidence’ was allowed at the second trial. Robertson tells me that even Judge Molloy questioned Donahoe as to why he was not objecting to this evidence being presented. Still, Donahoe did not object.

The second trial was completed last month. During the trial, Judge Molloy seemed upset that Robertson wanted his service dog with him. Robertson was required by his attorney to get documentation that authorized him to have the dog, Sasha, in the courtroom.

The second trial ended in a conviction for this 77 year old Navy veteran. He now faces prison and hundreds of thousands in fines. This will amount to life in prison and forfeiture of his property.

Mr. Robertson did not harm the environment, he actually improved it. However, the government did not control these actions, and therefore, seems intent on sending that message. Robertson, who served his country honorably, including tours in Vietnam, faces losing everything he built over his lifetime.

Robertson could now be sentenced up to 15 years in prison and a $250,000 fine. It would appear that their Federal Public Defender showed that he knows who he really works for, and it was not for Mr. Robertson. His oath to defend Robertson seemed not as strong as the oath to defend the government. In accordance with this stance, there currently is no appeal expected.

Sentencing is scheduled for July 20, 2016.

“This verdict sends a message that the United States will not stand by and allow streams and wetlands of the United States to be polluted, or National Forest lands to be injured,” said United States Attorney for the District of Montana Mike Cotter.

“Today’s guilty verdict demonstrates that polluters will be held accountable for their actions.” said Jeffrey Martinez, Special Agent in Charge of EPA’s criminal enforcement program in Montana.

As far as messin with a combat Veteran who served in Vietnam, the new generation of our supposed leaders in Washington, I really don’t think that could do anything right now because they are young and need to be schooled, there are still too many in Washington that need to forced to retire. Our younger generation is capable of the tasks at hand but aren’t being allowed to. I myself am a disabled combat Veteran, served in Vietnam, all the way up to the Gulf War(and everything in between the two)The Patriots are going to have to stand one day or we will lose our country, and believe me it’s coming.(AIRBORNE Mack all the way).

What the heck are those of us that want to stand but are constantly being told Not now suppose to do????? I have trained my arse off educated my kids , taken part in the times we did stand recently.. Yet I can’t help but feel so many like me are losing heart. Not in the willingness to fight but rather why does it seem so many are afraid to fight. Why are we so gun ghost to go fight for freedom in other countries but when it comes to OURS we sit on the back burner. I have family members that have died on foreign battlefields.       4. I think you are right brother. I have been saying this for years. I served in the army from 1964 to 1970. I have been in the va system since 1999. they almost killed me at the Atlanta va. now it continues in Denver co. they are trying to kill off a lot of veterans because they know we are the likely ones to take a stand to save our country. we have been fighting and dying for the 1% and their empire building. we all need to come together. we are afraid to loose something but in the end it will happen. they take us down a few at a time. there was a BROKEN ARROW given some years ago and no one answered it.

    2. If you really want your answer as to why the federal defender took the epa as the “experts” please. I’m begging you to watch this video. Only if we become educated can we answer these questions with facts instead of with conjecture. This is a video from a free online course from Hillsdale college. It’s an accredited college. No B.S. It’s the lecture on regulation and where our regulatory policy comes from today.         What was said in the lecture is correct in part.

        What was left out is that the Supreme LAW of our nation not only is law, but defines our government, assigns the delegated authority, and it also declares and defines the Separation of Powers – which is not only divided up between “We the people of the united States”, the states, and the general (federal) government, but further divides that up between different branches and to specific named offices within those branches. It also defines the LIMITS of which those who serve within the general (federal) government is to serve. That all law/regulation/codes/treaties/etc MUST follow (be in Pursuance thereof) the US Constitution.

        It still comes down to us, not to any person who serves within our governments, to enforce the US Constitution and state Constitutions. There is no delegated power to those that serve within our governments that allows them to give/trade/sell/borrow/etc the delegated authority to another agency/group/person/entity/etc. It reverts back to us when they do, plus they have committed many crimes.

        Consider the words of our ancestors and those that created that document, and you will see that what was put into writing within the US Constitution says exactly what it means, and that until we the people decide to change our government, all those who serve within it is bound by that contract, they can add nothing to it, they can take nothing away lawfully.

        James Madison, Report of 1800: “The (Virginia) resolution supposes that dangerous powers, not delegated, may not only be usurped and executed by the other departments, but that the judicial department also may exercise or sanction dangerous powers beyond the grant of the Constitution; and, consequently, that the ultimate right of the parties to the Constitution, to judge whether the compact has been dangerously violated, must extend to violations by one delegated authority, as well as by another; by the judiciary, as well as by the executive, or the legislature.

        Remember, that power not delegated is power RETAINED by us.

    3. Where are the feds, surly not along the Texas border. Here you have illegals laying all their trash on ransher’s property, destroying property, where’s the EPA on this. You have creeks, ponds, windmills being used for other purposes and pollution going into the Rio Grand river. As the Great One – Mark Levin states “these bafoons”! The EPA is no better than the TSA. The alpha bet agencies don’t care, they are letting in mass immigration, that means faster use of our natural resources _ water, etc. Every property owner, rancher, Veteran, farmer in the United. States should be pitching in financially to help this Montana Veteran win his fight against the EPA.

    That heading at http://www.fdom.org/OurAttorneys.htm above his bio seems to say it all. One would expect seeing the term “defender” in his federal job listing that he would be defending Robertson, but one must not forget the total title he is assigned “federal” is most likely the key word in his case. The fact that he would give a unconstitutional -so unlawful – FEDERAL agency such as the EPA the only group to present evidence in this case says much about who this person (who supposedly SERVES the PEOPLE) in the position he occupies (all who serve within our governments are supposed to) is really serving. It is not America and Americans – we need to remove him for breaking his lawfully REQUIRED Oath, and then charge and prosecute him for the felony it is and also the crime of Perjury. Remember that the US Constitution and Montana’s Constitution are both LAWS – of our nation and of the state, they must not be ignored any longer.

  2. Why is every one up in arms and complaining . No one is going to stop this crap. It will just keep going and going . Cause we would rather keyboard complain than stand in force and stop it. Cause we must hold the moral high ground. My friends isn’t it the moral high ground to stop an American , a Veteran , someone’s dad and grandpa, someone’s husband and brother from going to prison for the end of his life. My God brothers and sisters what else has to happen before we stop it. How many more good honest American men have to go to prison or the grave “Lavoy” before we say that’s enough. I’m sad rather heart broken to hear these stories but even more heart broken to see that we the Patriots are for what ever reason not taking a hard final stand.     The tyrannical bully is at it again. The kids are in the cafeteria talking. They don’t know what to do. They say “what can we do to keep the bully from beating us up?” They say “let’s be nice, and do all that the bully demands!” The bully comes in and punches one three times in the back. They say “let’s pay him some money”, but the bully comes in and simply takes it, and scares them all away. They gather again and say “let’s do as he says, and give him what ever he wants”, the bully comes and shoves the smallest to the ground, and sits on him causing him to sufficate under the 300 pound fat bylly kid. They run and stop, and say “what are we to do?”

    The whole time, the 50 teachers could have done something to control the bully, but they just looked the other way! They could have kicked the bully out of the room, but they just ignored it.

    A new kid comes to school the next day, and the bully says give me all your money. The new kid says “screw you!” The bully gets mad. The new kid laughs. The bully shoves him. The new kid lets out a bunch of whoop ass all over the bully, leaving him with a black eye, and a broken, and bloody, nose! The bully is put in his place! He no longer feels comfortable bullying!

    The moral of the story is: There was no need for a school wide riot, just someone willing to stand against the bully! And, a black eye, and broken, and bloody, nose is all it took!

    You all think a civil war would break out, and I think that is silly! What would happen is it would be impossible to ignore, and the people will see what happened, and become furious! And, the states will no longer be able to just look the other way, as they will see that they can and must step in to keep the peace! And the bully will be far less comfortable doing it again.

    A black eye, and a broken, and bloody, nose! The time for nothing has run its course!

        But who makes up the “regulated” (trained) Militia? Those who are trained as congress requires the military to be trained and that know the US Constitution and the constitution of their state since they are their supreme commanders in all that they do.

THE FUNDAMENTAL LAW OF THE MILITIA IS, THAT IT BE CREATED, DIRECTED AND COMMANDED BY THE LAWS, AND EVER FOR THE SUPPORT OF THE LAWS.”

        The US Constitution is the supreme LAW that ALL laws/codes/regulations/treaties/etc MUST be in Pursuance thereof (follow) to be lawful and binding on the American people. So all those “color of law” – regulations & codes, treaties – that were not created by the House of Representatives and the Senate (President and Senate when treaties are created) as constitutionally required are NOT enforced against the people.

        Alexander Hamilton, The Federalist Papers 28: “The militia is a voluntary force not associated or under the control of the States except when called out; [when called into actual service] a permanent or long standing force would be entirely different in make-up and call.“

        But when “called out” they are then paid the same wages that the military receive.

        George Washington: “A free people ought not only to be armed, but disciplined; to which end a uniform and well-digested plan is requisite; and their safety and interest require that they should promote such manufactories as tend to render them independent of others for essential, particularly military, supplies.”

        As you can see by that from a former General and former US President we are to create our own weapons of war so that we are NOT dependent on those that serve within our governments as they may be corrupt and not doing the delegated and assigned duties such as the only distribution of military weapons that they are allowed to do is to give them to the Militias to train on. By that constitutional requirement it them becomes forbidden to be given to any other group, nation, entity, person, etc.

        Now you should understand why the corrupt who serve within our governments are going after veterans. All veterans are trained as congress requires the military to be trained and it is easy to teach them the US Constitution and their state Constitution by them reading them, and then maybe perusing the debates that created them, what the forefathers and framers wrote, etc.

        Since those who serve within our governments are constitutionally REQUIRED to use the Militias for law enforcement, etc that makes the Militias the single biggest danger they have facing their “plans” to destroy our nation from within. There could not be any illegals flooding our borders as the US Constitution REQUIRES the Militias to not allow that invasion or any invasions.

        Those things make veterans the biggest enemy they have as, if trained as the military is trained and knowing the US Constitution, they have the full might of our legitimate and lawful government behind them in their actions, not those that serve within our governments.

        If there were never intended to be action to defend the Constitution from those who are domestically attempting to destroy its power and authority, why would each Oath require it of those who take the Oaths?

        1. Didn’t mean to set you off. Article IV, Section 4! The guarantee clause. States have a guarantee from the feds against foreign invasion! The feds are currently in breach of contract with all 50 states! Border control is a federal responsibility! It does not mean we can depend on them! And, we obviously can not! The militia is not that organized, and the numbers are not significant, and, as can be seen above, there is no respect for them at any level (except for patriotic Americans). They do not have the equipment, or numbers, to even take on the cartels! And, we are out of time! There’s no time to educate the public on the things they should already know!

          And, looking at the people, whose going to stand? The trump rallies, oregon, the media, all show us where America is at this moment! They will gladly accept anything that comes. They welcome anyone coming here, and will welcome any form of government. They will allow themselves to be tagged like dogs. They will gladly accept tiny living in communal spaces, with socialist ideals! And, this is where the economy, taxation, uncontrolled spending, is forcing them to go anyway! The rest of America is comfortable, they just want to get through life! They have nice houses, cars, and families. They don’t want to stand up!       1. The word UBUNTU caused me to think of Shanesha Taylor who everybody piled onto and as always – shame is such an effective tool. I never caught anyone mentioning how the money was hers free and clear so it seemed to me that the government was trying to set precedent by telling her what she needed to do with her money. I could be wrong but it seemed horribly wrong to me. Plus the piling on by everyone succeeded in making a fool of all those with a heart who donated. I will never know the complete situation or even if the gossip articles were true. So what if she got a place to live and got some furniture with the money. Little kids have eyes. They feel the have not. If you can’t afford TV they’ll soon enough be running away to a house that has one. Little kids are vulnerable to a lot of distortion around not having. They might hate their “loser” parent for it. They might be burdened with feelings of inferiority or shame or hopelessness because of it. There’s plenty of adults accepting stray kids these days with no questions or even attempts to contact their parents. Worse, if you fall on hard times due to illness for example and you are facing homelessness due to the gap between when your benefits and savings runs out and qualifying for disability – oh everybody offers to care for your kids but they expect your sick body to live under a bridge somewhere because somehow as an adult it’s your fault that you got sick. The Fed. court will only entertain cases that are in violation of the constitution. Did the lower court have a presentment or indictment from a Grand Jury as stated in the 5th Amendment?   9. I was born and raised in Missoula, MT. I am a veteran of 2 of our Nations military services: US Navy 1976-1980 (enlisted) and US Army (officer and retired as a Lieutenant Colonel) 1980 – 2006. Twenty-nine years 10 months total service. I started this with that information so readers can get an idea of who I am.
    Many of the posts people have written on here seem to think a violent confrontation with the Government (OUR Government!!) is the only way to resolve injustices committed by our Government. While I agree there are many thing that need “fixing” at all levels of our Government, I do not believe that violence is the answer. Their is another way! Away established by our forefathers to give us the power to rein in an out of control government. Article 5 of the US Constitution establishes a ‘Convention of States” process to amend our Constitution. This process is controlled and operated by the States, not the Federal Government and is currently on the way to being ratified by the required number of States.
    So, how about we support the Convention of States process and amend our Constitution to get the Federal Government back to it’s constitutionally specified mission (Article 10 of the US Constitution states that the Federal Government has ONLY those powers specifically granted to it by the Constitution.) before even considering an armed response to Federal Government overreach. We can achieve what “We the People………. ” need by using a lawful procedure given to us in our Constitution by our countries forefathers. Anyone who prefers revolution, war and killing over a peaceful, legal solution is either an idiot, crazy, or a fool.
    Google Convention of States for more information. Wouldn’t it be great to have the Oath Keepers AND the Convention of States groups working together to make a better America for us all???

  10. The Bundy ranch incident made my heart grow not shrink in cowerdess. My eyes welled up in true American pride. This…I know…is truely the America I grew up in and was so proud as a young boy when I put my hand to my heart and pledged allegiance every morning before class. That pride is so engrained in goodness and faith in God that I too am willing to die even today at 67 for my Country. I will go to arms in a moments notice just as our brave and courageous forefathers for what I knew was right as a young man. Just as the bully example…we all know the bullies take out one at a time…with 5 to 1 odds. But when the tables turn…with force of goodness, Rightiousness we win hands down. Our forefathers dropped everything to fight for the good and Rightious cause….their families, their wives, their children and their jobs to fight the good fight even in squander and famin and sure death to many. Does it take a Bundy ranch incident AGAIN to wake up the sleeping giant…only to fall back asleep feeling THEY DID IT.. now everything is ok. IT’S NOT….AND NEVER WILL BE. Tyranny lives among us day in day out. From the tyrannical boss all the way up to the President. We were warned over 200 years ago by Angels from God…our Founding Fathers…that this day would come. AND what we are to do to save our beloved Country once again. Are we to wait and grovel over social media to find our George Washington and call to arms as our tears of fear fall on our most sacred document. My Country is being torn to shreds before my very eyes by just a handful of devout Communists. And just like the JEWS in Nazi Germany we walk side by side to the gas chambers under the guidance of 15 Nazis with machine guns. Yes…many will die…but more will be saved to fight again tomorrow. Doesn’t matter what social media shows you. The few are complete and total idiots. The pictures we see on TV and YouTube are meant to instill fear, my friends. They are few to our many. We can let the few…the Bilderburgs, the CFR, SPLC, Banks, Goldman Sachs March us blindly to the gas chambers holding our loaded weapons with our fingers ON the triggers…..or we can stand up like my father did in WWII and take the fight to them. Our lives, our children’s future, and the future of our Republic depend on US…AMERICAN MEN to stand up and take that first shot. Our Founding Fathers made it very clear…when we do what we can do within our corrupt legal system, when it’s terrifyingly clear that we have tyrants that are taking over every minute detail of our existence…THAT, MY PATRIOTIC FRIEND…IS THE CALL TO ARMS! We can ALL be George Washington….we can ALL carry our freedom loud and proud on our shoulders and stop the BS. If you or any one of your friends find it difficult to read the Bible, or study World and U.S. history …and watching over and over again The Patriot, the Sons of Liberty, the Bundy standoff, and finding that there is a not a tear in your eyes or your heart doesn’t pound harder and faster…then…there is no hope for America. History, well after we’ve perished, will show that THIS generation gave it all up. Or probably not even mentioned on the last page of a school book. Our time is NOW…we can’t wait to be nice and tolerant Americans asleep at the throttle, or just nudging it when we’re allowed, or waiting til a Jihadist shows up on your doorstep. It’s time for ALL patriot groups and individuals to bow to not in fight, to get together and go underground and use old technology to communicate and get this job done so we can go back to our families and once again kiss Old Glory with pride.

The Farm-to-Consumer Legal Defense Fund recently won a similar case wherein the EPA was declaring a pond installed on cattle property to be ‘polluting’ and in violation of the ‘law.’ The organization provides legal services to its members when government overreach infringes on property rights, one’s ability to raise and sell food products, farming issues, etc. Attorneys are available 24/7 by phone so that when agency personnel, or even SWAT teams, show up to your property, one has legal help immediately; many times the attorney will speak directly to the ‘enforcer’ enabling a back-off result. Membership is required. I’m not certain if there would be a willingness to be involved at this point, or what the financial conditions would entail, but it may be worth checking into.

    Thanks for your service, but I need you to clarify something for me please. When you say “our government” are you speaking (writing) of the US Constitution our legitimate government that you are Oath sworn to “support and defend”?

    Or are you speaking of the people who SERVE WITHIN our government – elected, hired, contracted, etc? Because we owe not one person who serves within our government loyalty or fealty UNLESS they do the duty they are under contract to do as it is written, and they take and KEEP the lawfully required oath. Think I am wrong? Let me prove it to you.

    All authority the people (and states through the peoples representatives) delegated is delegated to the branches and/or to offices within the branches, NOT to the people who serve within them. Those that serve within our government(s) are ALLOWED to use that authority (power) as long as they keep the contract and Oath and that is in writing within the supreme LAW, the definer of our government, and the contract that ALL who serve within our governments are under.

    J. Reuben Clark spoke about the need for a solid support of the Constitution: “GOD PROVIDED THAT IN THIS LAND OF LIBERTY, OUR POLITICAL ALLEGIANCE SHALL NOT RUN TO INDIVIDUALS, THAT IS, TO GOVERNMENT OFFICIALS, no matter how great or how small they may be.     Think he is wrong? look what has happened to our country by those who misplaced their allegiance to the people who SERVE WITHIN our government and are given specific put-into-writing duties to perform.

    Who was your Oath to? If it was legitimately an American Oath, it was to the US Constitution, NOT TO ANY PERSON SERVING.

    1. You gave me a lot to think about, and I appreciate the schooling, I truly do. I’m not LEO or a vet, just a guy who shoots off when I see wrong doing. I appreciate, and support, Oath Keepers, and people like you for your constitutional thinking. Thanks again Cal for the good info.Personally when i mention violent confrontation i am referring to defending ones self,family or property from an oath breaking ,unconstitutional arrest or search,.Seems like more and more citizens are being harrassed,extorted,terrorized by these illegal agencys.One by one,so many lives ruined.This mans live has litterally changed overnight. Where is the community of which i read he was such a integral part of?

Not that anyone hasn’t suggested this before, but I would like to propose that Oath Keepers, and like minded organizations (CSPOA), get together and setup a legal defense fund that everyone can donate to, that can be used to direct funds for legal defense in situations like this, and educate people in the area on their rights, their rights as jurors (nullification), and to promote recall elections to remove those who let these things happen.

  15. I find it disgusting that a jury would convict a just man. Oh but wait, they are not peers, they are chosen both by prosecutor and defender. They are neither friend nor family. A peer is like minded. If your are a pilot, then your peers are pilots. If your are a man constitutional values, your peers are also an equal. A peer is friend and family. Our courts are a scam.

I worked 6 years as an investigator in a State Public Defender’s Office and almost without exception I found the lawyers to lean way to the political left which is why I no longer work for the Public Defender’s Office. I heard the only black attorney continuously call all cops “racists”, I watched a lawyer encourage his client to lie in court and claim he never confessed to the police, and I was constantly bombarded with anti-conservative political cartoons sent around attached to routing slips (where you had to initial saying you saw it) by the Public Defender himself. I hope a “real” attorney will step up and represent Patterson in his appeals.

  18. With nearly 20 years in corrections and some contact with prosecutors I have found that the prevalent attitude of those in such positions have only one goal. That is to obtain a conviction and a maximum sentence. These people cannot and will not admit any error nor will they stand down. They have deep pockets and will easily bankrupt any defense effort. There is no relief from this kind of “justice”.

  19. This is just like the Oregon standoff. Putting innocent civilians in jail, fining exorbitant amounts, and killing of innocent men, then taking their land.
