Oath Keeper, Sheriff Brad Rogers


The term “constitutional sheriff” is used often within the Liberty Movement. It is just as often used used by those that would try to lambaste the movement as well. I think that there are a lot of folks out there that do not fully understand what is really meant by the title of “Constitutional Sheriff.”  It is my belief that the office of a duly elected County Constitutional Sheriff truly is one of our most powerful defenses against the overreach of bureaucratically appointed, alphabet soup, agencies into our home counties. A well informed Sheriff can keep those that would wish to overreach their authority at bay, right there at the county line better than any other single agency. I had a chance to see this strategy at work, first hand, while helping Constitutional Sheriff Denny Peyman, of Jackson County, Kentucky, when his funding had been stripped by the local Chief Executive, after Sheriff Peyman had arrested him on corruption charges.


I first met Sheriff Brad Rogers, of Elkhart County, Indiana, while I was at Bundy Ranch, covering the event for alternative media. Out of all the public officials and law enforcement that traveled from across to country, to help ensure that another “Waco event” didn’t happen on our watch, I had the least time to interact with Brad. I am glad to have had a chance to catch up with him while working on this piece. In the following interview, we discuss why Brad was first drawn to law enforcement as a career choice and his first awakening to what it means to be a “Constitutional Sheriff.” We discuss some of his more notable battles that he fought, and won,  in Elkhart County, Indiana, against the FDA and other agencies, while protecting the constitutional rights of his fellow citizens. We also discuss his thoughts on the stand off in Oregon and the following repercussions.


There were 3 in total that I met there at Bundy Ranch, and all struck me as men that walk tall. Each of them relating to me the most incredible stories of how they were all serving and protecting the people of their counties. Sheriff Brad Rogers, Sheriff Denny Peyman, and Sheriff Jeff Christopher are all very dynamic and unique characters, but they are united by the bond of being driven to do what they felt was right. They all strive to keep their constituents safe from the IRS, FDA, and any other federal agency they feel are not following the supreme law of the land, and overreaching their authority to victimize the people of their counties. Stewart Rhodes

Stewart is the founder and National President of Oath Keepers. He served as a U.S. Army paratrooper until disabled in a rough terrain parachuting accident during a night jump. He is a former firearms instructor, former member of Rep. Ron Paul’s DC staff, and served as a volunteer firefighter in Montana. Stewart previously wrote the monthly Enemy at the Gates column for S.W.A.T. Magazine. Stewart graduated from Yale Law School in 2004, where his paper “Solving the Puzzle of Enemy Combatant Status” won Yale’s Miller prize for best paper on the Bill of Rights. He assisted teaching U.S. military history at Yale, was a Yale Research Scholar, and is writing a book on the dangers of applying the laws of war to the American people.



  1. I think we are on the verge of a fedgov that no longer cares, and isn’t far from moving against constitutional law enforcement, politically, and physically. Other than the deputies, who’s to stop them. And, if they don’t come for you now, it may be a year from now, or five years. I think we are on the verge of total “state-collapse anarchy” within fedgov. Everyone says they are running scared, but they aren’t scared at all. They are bold, and in your face tyrannical.

    The sheriffs, and states are our best defense, if they stand up, and if they are backed up. And, only if they do in far greater numbers than we see today. We see this, but we see it on a very small scale. And, I seriously doubt there would be backing from any of the 50 states. Seriously, where are the states in all this? Why in the world do they bend to an unlawful / unconstitutional fedgov? The answer is simple. They are hogtied by bureaucracy! It’s not like all this hasn’t been going on for a long time!

    Fedgov is so unconstitutionally entrenched throughout America, that few see it as a problem anymore. And, a constitutional sheriff here, and a constitutional sheriff there, isn’t going to save us. Unfortunately, it would appear this is the year that things explode. So it’s a good effort, but may be too little, too late. The effort is weak, when it needs to be titanium strong.

    But, more power to you all! We need you now, more than ever!

    1. @ Skeptical.. My Oath Keeper Brother…it is YOU and I that MUST stand beside the Sherriff and his Deputys.. WE are the ones.. My baby brother is a Deputy..and I WILL STAND BESIDE HIM and all the others .. it is WE..if not us…then WHO ?

      1. I agree 100%, and I’m there. I’m skepticle, as I see unconstitutional feds operating everywhere with no consequences. They are clearly out of control, and unconstitutional, and yet even the good sheriffs do nothing. And, because of absolute ignorance, the states could care less, and the majority of people could care less.

  4. I hear this sheriff talk and I just keep on thinking, normal. What happened to police that used to think in a normal manner and like Sheriff Rogers talked about to serve and uphold the constitution, instead of the way the police typically operate today? Police seem to be indoctrinated into a system that looks at everything (everyone) as doing wrong and they need to apply a heavy hand against us. They really seem to revel in busting us all and also revel in the massive power they wield. If everyone just thought normally and followed the constitution leaving everything else out we would do fine.

    1. My father was an Alaska Territorial and then, upon statehood, an State Police Officer. From the time I was 5 on, he would tell me never to allow any police officer to touch me without the 4 magic words: “you are under arrest”. Upon that notification, your constitutional rights are suspended to the authority of the police officer. Now, they say if the police office grabs you, without any such notification, that is sufficient.
      We have a constitution. We have rights. We are not subjects.
      The States are not subjects of nor subordinate to the federal government.
      We have to take the States back by electing and appointing people who understand the Constitution. Liberals view the Constitution as an impediment to their ideological goals and have to circumvent or eliminate it. Look at liberal gun laws and liberal 1st Amendment laws.
      Where is the violent crime in this country? The drug use? Drug turf wars? Mass killings? Blue cities, towns, counties, and states. There are literally two Americas.
      There will be a civil war, with the imposition of Islam, and the divergence between the left and right. The right want a rule of law with the Constitution as the Supreme Law of the Land, the liberal wants the Constitution out of the way to impose their socialist/communist agenda–Europe is failing under that agenda and the idiots want the same here?!
      What is now a Democrat, we used to call a communist.
      Same ideology.
      Constitutional Sheriffs can be a powerful tool in trying to correct what’s happening in law enforcement, but one thing is for certain, sheriffs are elected. Police chiefs are not and are the dog of the mayor and city council. The police chief reflects the ideological goals of the city administration. The constitutional sheriff reflects the will of the electorate.

  5. I don’t want to rain on your parade, but if you think the feds are close to being an Un-Constitutional organization of crime, you have not been paying close attention. Remember when Charlie Rangle was being investigated by his cohorts for sitting on the committee that writes IRS (3 letter terrorist regulations, while committing tax fraud, he was asked “isn’t a lot of the laws you write Un-Constitutional”?(he was made to pay a fine, and then make more IRS rules). His reply was of course they are, we write Un-Constitutional laws every day, if you don’t like it stop us! The question is how? Now that the law has been hijacked from a common law system, to a commerce/statutory system, there are no Statutes written for the Common Laws that were written, that is because you did not need to write a statute for a common law, none needed, or the founders would have written them to enforce the Constitutional law based system. Now there are a set of statutes written that do have statutory law effect, they can be found in USC 18, the laws the government can be held accountable for. That means we have laws on the books under their new un-lawful system to prosecute them! Please look them up, and help me find a Constitutional Sheriff, and an Attorney who will hold a Citizen Grand Jury to indict them! This is the power of the new revolution, use their laws against them!!! Or buy a copy of rules for radicals, and reverse everything in that communist book to win a battle using their own rules against them!!! Then have fun every day as I do to use their BS ideology against them!!!
