New Ban Bill Hits Congress: Targets Semi-Automatic Rifles & Handguns

In the wake of the Sandy Hook shootings we warned that sweeping changes were in the works for Americans’ right to bear arms. It started with ammunition tax proposals, restrictions on firearm accessories imports and most recently Governors began bypassing Congress altogether by banning gun ownership for those on any of the government’s many watchlists. The Obama administration has also targeted licensed firearms sellers across the United States by forcing banks to treat them like pornography businesses and impeding their access to transaction processing systems and business banking accounts.

States like California already ban “assault weapons” and outlaw “high capacity” magazines that can hold more than ten rounds of ammunition. But the kinds of restrictive laws that strike at the very heart of the Second Amendment of the U.S. Constitution have thus far been limited to just a dozen or so heavily liberal states.

Until now.

While Americans anxiously prepared for their Christmas festivities, anti gun proponents in Congress were hard at work drafting a new bill. If passed H.R. 4269 would literally redefine the Second Amendment as evidenced by the bill’s description, which in no uncertain terms clarifies its ultimate goal:

“To regulate assault weapons, to ensure that the right to keep and bear arms is not unlimited, and for other purposes.”

The bill directly targets every semi-automatic firearm in the United States including handguns, shotguns and rifles. It specifically mentions certain firearms and manufacturers, including the popular AR-15 and AK-47 rifles.

Because the law is Federal it would blanket the country with new restrictions, including making it illegal to own any magazine that exceeds a capacity of ten (10) rounds.

And here’s the kicker, even if your weapon has a legally-defined low capacity detachable magazine but is modified with any of the following accessories, it is considered an “assault rifle” and would be outright banned in the United States.

Semiautomatic rifle that has the capacity to accept a detachable magazine and any 1 of the following:

“(i) A pistol grip.

“(ii) A forward grip.

“(iii) A folding, telescoping, or detachable stock.

“(v) A barrel shroud.

“(vi) A threaded barrel.

“(B) A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 10 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.

“(C) Any part, combination of parts, component, device, attachment, or accessory that is designed or functions to accelerate the rate of fire of a semiautomatic rifle but not convert the semiautomatic rifle into a machinegun.

To be clear, the new bill puts all half measures aside and goes for the jugular.

This is the worst case scenario that many Americans have feared.

If you own a weapon on the ban list or have accessories as described by the bill, your firearm will be outlawed in the United States of America.


(a) In General.—Section 922 of title 18, United States Code, is amended—

(1) by inserting after subsection (u) the following:

“(v) (1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a semiautomatic assault weapon.

“(37) The term ‘large capacity ammunition feeding device’

“(A) means a magazine, belt, drum, feed strip, or similar device, including any such device joined or coupled with another in any manner, that has an overall capacity of, or that can be readily restored, changed, or converted to accept, more than 10 rounds of ammunition;

“(w) (1) It shall be unlawful for a person to import, sell, manufacture, transfer, or possess, in or affecting interstate or foreign commerce, a large capacity ammunition feeding device.

The bill was introduced in Congress on Decemeber 16, 2015 and currently has 123 co-sponsors – all democrats.

We know that gun bans don’t work but one can’t help but think the agenda goes much further than the notion that they want to make us safer. If that were the case then our lawmakers wouldn’t allow drug cartels, gang members and Islamic terrorists to cross into the U.S. through our porous southern border.

The reality is that a cloud of tyranny has descended upon America. For it to be successful the American people must first be disarmed.

As history has proven time and again, a disarmed populace can easily be led to slaughter. But unlike the tens of millions executed in ethnic, religious and political cleansings of the 20th century, Americans have a rich tradition of personal liberty and the right to bear arms. It is embedded in our culture and our founding document. And as Texas police chief Randy Kennedy recently warned, if the government pushes too far they may well incite a revolution.

  1. The biggest problem I am seeing….idiots like New York’s Governor Cuomo actually believes the “No Fly List” is (1) not flawed and (2) a very good method for disarming terrorists. His reality and those like him are very ignorant and have not done their homework, or they are just stupid morons that will use any loop-hole to eventually add anyone THEY want to the “No Fly List” and attempt to enforce a “No Gun Buy List.”

    ANYONE with intent to murder or terrorize are NOT going to be swayed by being on the “No Fly List.” Black Markets pop-up overnight when certain items are banned and (also) corrupts local and federal law enforcement agents. The “War on Drugs” did just that !

    ALL dictators disarmed the people….and that is Obama’s legacy he is hoping for, and if not him….Hillary Clinton.

    1. I don’t think the gun-grabbers care what the “no fly list” was intended for. There is no due process involved in placing someone on the list, and it’s secret. This administration has a history of targeting their “enemies” illegally, like the IRS targeted Tea Parties for years. It will become an enemies list, followed by surprise gun confiscation.

I do not own any so called assault rifles but if this shit passes, I suspect there will be a lot of them lying on the ground for any patriot to pick up and put into proper use.

      1. I have done my part I was at the bundy ranch in was at the sugar pine mine I also train my area off and try to wake up locals in my community. I am not a computer commando. My wife a 3 kids including myself have eaten bologna sandwichwiches and cup of noodle for months to insure we sacrifice to help where help is needed. I have also listened patiently. To my brothers and my elders to stand and be patient. So know this I’m not worrying about what others are dosing I’ve made the 14 hour trips and my family has eaten crap to sacrificed. for the service of others. I’m a CRO (chief range officer) on the run and gun ranges here and we’ve been swamped by the masses of people who suddenly realized that not only do they need to own a gun but need to know how to move and shoot. Every time Obama opens his mouth more show up. I’m thinking that there is a standing army quite a bit larger than we first imagined. I’m hoping the feds realize that fact also and back off the violations of our Constitutional rights.

  10. There has been much talk for years and the anti gunners keep whittling away. People trying to hide their weapons and waiting for them to come get then one at a time is their plan. there is only one way this will ever stop. The talk must stop and those weapons need to be delivered En Masse to where it will hurt most. That is the only way to force a peaceful resolution. Otherwise we have simply talked ourselves into surrender. The second amendment was written for now.

      3. They would have to send fully equipped military, anything else would be inadequate to the task, and even then, they won’t be making an “example” out of anyone. It would be like walking into Afghanistan.

  11. Not that it makes this nonsensical bill OK, but our so called assault weapons as well as our riot guns and handguns (that can accept extended mags which essentially means any semiautomatic handgun) will be grandfathered in. Even so I would imagine they will try for a registry

  12. IMHO it seems a ‘foregone conclusion’ that they must (certainly) already have a registry right down to what kind of firearm, serial # and all other relevant data. That much can be gleaned from filling out a form at The Sheriff’s Office “for a permit to BUY a handgun.” Then another $90 bucks (was 80) to get a Concealed Carry permit then add about $120 to take a one or two day course (NRA or State Approved). That’s what our neighbors just paid out…wow!
    Anyway …what I meant to point out is that there ALREADY IS A REGISTRY and if you’ve purchased a weapon via any FFL and it was related with getting ‘papers’ from the local Sheriff …then you ARE on the registry. The FFL is loaded down with the sending out of very detailed information too. (I’ve no idea where it may go either).
    Am I wrong?

      1. I like to point out those how worry extensively about keeping their gun ownership private, but every time I’m at a the water cooler at the office, or at the store buying ammo, some stranger is telling me all about himself and his toys – maybe I just have a welcoming face?

    1. In the mid 90’s I bought a new pistol from a dealer in WA. State. I immediately had problems with it and the dealer sent it back to the manufacturer. Weeks later I contacted the dealer and they informed me that my gun had been stolen off of a UPS truck in NY. So they gave me another. About 15 years later and after I had moved twice. I was contacted by the ATF and asked what I had done with the gun as it had been found after being used in a crime. They obviously have a data base.

    2. @Equorial Hi, I remember when we were speaking of the existence of God, you said that you were a retired LEO. If you don’t mind me asking how do most of your X-co-workers feel about this situation that has been going on forever(Seems like it)?

    3. An FFL is a “soft” registry, if you will. The information is not sent immediately to the ATF. It’s recorded in our A&D books which never see the light of day unless we go out of business or die, in which case they’re sent to the ATF. They can call upon the licensee for information about a specific firearm, but I’ve never heard of them asking for the information en masse. That’s not to say that they wouldn’t attempt it, just that I haven’t heard of it happening before.

      And it’s really beside the point as far as how detailed the information is. If it comes to confiscation, all they need is a suspicion of an individual owning a firearm and they’ll tear your property apart, I’m sure. So if you’ve ever purchased a firearm legally from a licensed dealer, you’re already registered.

    4. You are wrong, The paperwork done at you FFL stays in his files nothing reported to any one. If he or she ever gives up their FFL license, they must send all their records to Fairfax VA for mass storage.

    5. No, Equorial you are not wrong! We must live in the same state! I had to go through the same exact procedure and everything, right down to the shotguns, are registered or you simply don’t get them. In Indiana, totally different story in some counties. Depends on the sheriffs. No proper training in my state for defense tactics and such so I go across state for my needs plus I’m former military with a specialty. This registry will be compiled and used against the populace to “secure” any weapon the gov’t may think can be used against them and they will use local LEO’s to do it if you don’t have strong Constitution Law Enforcement leadership. IMO.

But alas, as recent history shows we will not, in the end they will get our guns.     1. We’ve moved far beyond the usefulness of marches and protests, even armed protests. And, an armed march into DC is probably the most foolish idea that is relentlessly pushed in the movement. We do not need another Fort Sumter. The CPT program is FAR more useful in preparing Americans and providing deterrents to tyranny. OK editors appear to have adopted the guarded attributes of MSM. “Author” Brandon has come on the scene and taken over all open discussion appearing to serve an agenda, resulting in a suppression of ideas and opinions.   14. SMOKING GUN that destroys any attempt to regulate or otherwise ban ‘Assault Weapons’ by either the Federal Government or a State. These are the US Government’s own arguments in the only case regarding the 2nd Amendment prior to Heller argued before the Supreme Court. It determines that the 2nd Amendment does indeed specifically protect our rights to own Military Type weapons.

    Interesting how no one ever mentions this. Pay particular attention to the 3rd and 4th points argued BY THE GOVERNMENT regarding the types of weapons protected by the 2nd Amendment.

    This is still the highest precedent in case law regarding the 2nd Amendment. Please share with the world.


    United States v. Miller, 307 U.S. 174 (1939), was a Supreme Court case that involved a Second Amendment challenge to the National Firearms Act of 1934 (NFA).

    On March 30, 1939, the Supreme Court heard the case. Attorneys for the United States argued four points:

    1) The NFA is intended as a revenue-collecting measure and therefore within the authority of the Department of the Treasury.

    2) The defendants transported the shotgun from Oklahoma to Arkansas, and therefore used it in interstate commerce.

    3) The Second Amendment protects only the ownership of military-type weapons appropriate for use in an organized militia.

    4) The “double barrel 12-gauge Stevens shotgun having a barrel less than 18 inches in length, bearing identification number 76230” was never used in any militia organization.

    Neither the defendants nor their legal counsel appeared at the Supreme Court. A lack of financial support and procedural irregularities prevented counsel from traveling. Miller was found shot to death in April, before the decision was rendered.


    On May 15, 1939 the Supreme Court, in an opinion by Justice McReynolds, held: The National Firearms Act, as applied to one indicted for transporting in interstate commerce a 12-gauge shotgun with a barrel less than 18 inches long without having registered it and without having in his possession a stamp-affixed written order for it, as required by the Act, held:

    1) Not unconstitutional as an invasion of the reserved powers of the States. Citing Sonzinsky v. United States, 300 U. S. 506,[2] and Narcotic Act cases. P. 307 U. S. 177.

    2) Not violative of the Second Amendment of the Federal Constitution. P. 307 U. S. 178.

    The Court cannot take judicial notice that a shotgun having a barrel less than 18 inches long has today any reasonable relation to the preservation or efficiency of a well regulated militia, and therefore cannot say that the Second Amendment guarantees to the citizen the right to keep and bear such a weapon.

    In the absence of any evidence tending to show that possession or use of a “shotgun having a barrel of less than eighteen inches in length” at this time has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument. Certainly it is not within judicial notice that this weapon is any part of the ordinary military equipment, or that its use could contribute to the common defense.
