California Gun Seizure Edict a Naked Power Grab that Ignores True Danger

“Gun-safety legislation going into effect in California next week will allow authorities to seize a person’s weapons for 21 days if a judge determines there’s potential for violence,” Fox Nation informs readers in a summary post of an article from The Washington Times.  Curiously, that story calls it “Gun control legislation,” making it fair to ask who directed such an editorial change and why.

Because, as always, what the gun-grabbers are doing has nothing to do with safety, and everything to do with conditioning the public into accepting citizen disarmament as a solution to violence.  Of course it’s about control.

The bill itself, signed into law by Gov. Jerry Brown in Sept. 2014 and scheduled to go in effect on Jan. 1, 2016, is posted on the California Legislature website, along with votes, history, analyses and the like. For the average person, a more digestible explanation of what it does is presented by the Law Center to Prevent Gun Violence – just keep in mind, if you get your information from them, they’re a group that actively undermines the right to keep and bear arms.

Basically, it allows family members or police to go to court and obtain a Gun Violence Restraining Order. The big emotional hook used to drag a critical mass of the voting public on board was the Isla Vista shooting incident, where a nutbag privileged kid who’d been in therapy since childhood racked up multiple victims he went after with a knife, a car and a gun.

Naturally, no new knife or car laws were introduced.

And naturally, there were plenty of prior indicators the kid was screwed up, including police being contacted by his alarmed parents. Deputies working for Sheriff Bill Brown (yeah, that Bill Brown for those of you who have followed WarOnGuns for a while) talked to him and didn’t do anything.

Here’s the thing: California already has Welfare and Institutions Code Section 5150, which allows an officer to get a person confined if suspected of having a mental disorder that makes him or a danger to himself and others. And the gun used was registered, meaning they got the call and had a record of it – if they cared to look. There’s a chance the murders would never have happened had authorities used existing tools.

But they didn’t, the powder keg was allowed to blow up in a very public way, and the explosion was exploited by the blood dancers for all they could squieze out of it to create another “gun law.”

But wait—am I saying let psychos have guns? Don’t we want to make sure they’re harmless?

Does anybody see anything in this absurd affront to liberty that will do that?

I have a saying I’ve been using for some time, a truism, actually:

Anyone who can’t be trusted with a gun can’t be trusted without a custodian.

Remember that the largest mass murder in our country’s history was ostensibly (that is, according to the official story), enabled with box cutters, the second largest with some fuel oil and fertilizer, and the one after that with a dollar’s worth of gas and a match. And no, sorry, I just brought those up to make a point, not to start a debate on alternative theories

Back to the point I’m trying to make: So they take his guns away but leave him to stalk among us, and that somehow makes everybody safer? That will do nothing about access to other means of mayhem, plus, it’s not like bad guys can’t get guns if they want them. If some maniac is too dangerous to have on the loose with a gun, he’s too dangerous to have on the loose, period. And no, you don’t need to wait until he starts piling up bodies to act.

There’s nothing wrong, if bizarrely inappropriate and frightening behavior warrants, in intervening and observing, and if appropriate, segregating someone from those he would harm. But justice demands before depriving any citizen of liberty, he must be afforded full due process. And by that I don’t mean just taking the word of some anti-gun metrosexual urban shrink, but ensuring equivalent protections of a full jury trial.

And when do we let him out?

When he’s demonstrated to be no longer a danger. If an animal attacked a human, would you open the cage and set it loose just because an arbitrary time sentence had been served?

When it has been determined someone convicted under full due process no longer needs a “custodian.”

When he can be trusted with a gun.

  1. So the entire state of California gets screwed again, thanks to NRA. In this case thank’s to NRA’s *seemingly* bizarre decision to throw out a pro-gun Sheriff and replace him with a gun grabbing brownshirt who happens to be in the same county as the NRA’s pet insurance company.

    What did NRA staff personally get in return for this? Was it a favor for the owners of their insurance company?

    It sure as hell wasn’t based on the gun rights considerations.

And it wasn’t the American people in California that voted out the sheriff in question, it was some how the NRA (OR ME, BECAUSE I AM THE NRA) that single handedly voted this anti gun sheriff into office!

        Are you lying about the NRA being the only group that does anything in court, or are you really that ignorant? NRA tried to sabotage Heller, then jumped on board late in the game to avoid getting scooped, and then took bogus credit for it. Typical NRA M.O.

        Apparently you didn’t bother reviewing Codrea’s articles on the sheriff’s election and its aftermath. Despite warnings from local activists who knew both sheriffs, Brown’s history of public opposition to concealed carry, and Anderson’s public support for concealed carry and decisive, courageous public opposition to gun control hysteria after a post office shooting, the NRA gave Brown an Orange Emergency Alert mailing to NRA members in the district, money, volunteers, and a phony A+ rating. Totally fraudulent and corrupt.

        But you say the NRA is blameless and it’s the voters’ fault that Brown won by a hair? How twisted and ignorant is your reality? Do you know anything about elections? You don’t think a phony grade, money, volunteers and a county-wide Orange Alert campaign by the NRA could make the difference in a tight election? And whether or not it did, why did the NRA trash a pro-gun sheriff and campaign for a known gun grabber?

        Brown quickly revoked all civilian carry permits in the county except for a few of the usual “important persons”. It’s Brown’s department whose gross negligence failed to stop the massacre. They didn’t need a new law. They already had plenty of probable cause for detention/observation and a search of the apartment. And it’s NRA’s “pro-gun champion” Brown who ensured that the community was defenseless, with no chance of civilian resistance to the shooter.

        If you’re the NRA and you support such betrayals, then YOU DID THAT. KUDOS!

        1. I happen to live in Nevada, and Harry Reid is my non-reprehensive representative. Up until Obama came into office he could always be counted on to vote 100% for gun rights. A matter a fact he has never voted for or brought anti gun legislation to the House floor, even under Obama. There is one thing you might want to understand, the hotel unions have supported Harry Reid over the years with a hell of a lot of money and votes from their union members (yes the same hotels and casino SEIU union members you support when you stay here!! Please keep that in mind when you come here. Or better yet not!). So it has been nearly imposable to get a conservative voted into the Southern part of my State, and yes we have tried over the years! The NRA telling it’s members to vote for Harry Reid had all to do with the pro gun votes I mentioned above, and this was long before he went full on Socialist nut case on us all here in Nevada. All I can add is the NRA did NOT advise it’s members to vote for him four years ago when he came up for reelection, and he still won.

The problem that I have not seen addressed is ex-spouse’s, jilted lovers, angry neighbors are liberal children or people who just want to get even with someone going to the courts to deprive people of their constitutional rights. The gun owner then has to go to the courts or to a psychiatrist and prove that he is not a danger. The problem is you cannot prove a negative ! After which the guns will be gone forever.

Much of the gun violence in America is associated with people who were known to be mentally ill, but the authorities did nothing to involuntarily commit them and prevent the violent acts they later committed. Examples include the Aurora theater shooter, the Virginia Tech shooter, Gabby Gifford’s shooter, the Sandy Hook shooter, and the Oregon Community College shooter. All shooters were well known to local government officials and the local mental health community, but nevertheless, their mental health status was not reported by government officials to NICS. Government’s reaction has been to declare vets who appoint a fiduciary to handle their VA affairs as mental incompetents, but a guy who dresses up like the Joker and dyes his hair red (the Aurora theater shooter) is OK. How about government officials doing their job and actually reporting mentally ill people to the NICS?

    The presence of seriously mentally ill people on the streets traces back to the Lassard string of cases in the mid 1970s that effectively ended involuntary mental health commitments and to the explosion of the prescription of psychotropic drugs (all of which have side effects) to treat mental illness.

  4. I was a CA resident for 18 months, I was retired for 10 yrs on SSDI before we relocated there. My now ex (woo-hoo) lost and couldn’t find a job, maybe because she wasn’t looking, and would only take management positions, after all she finished 9th grade. As we were losing everything and going broke she got us into serious debt. During most fights she told me she wished I was dead. I left one day and ignored her and went to beach. She decided to call the police and tell them I was suicidal and they took my guns and when I cam home 2 cops hauled me in for eval. Sunday night I waited until MON AM to see 2 drs. who realesed me in 15 minutes. She had given them my guns. I tried to get them back, and twice the state gave me clearance they were to be returned, but a city atty in Santa Rosa told me I would never see them again because he hates guns, and my only option was 3 – 5K in court fees. So here was a city atty over riding the state and federal laws on his own. Before I could get them back, she decided after getting us 13000 more in debt to divorce me. I returned home, she was allowed to lie, cheat, file false documents and phony IRS filings to screw me over, after all the judge was her sisters friend. CA is so screwed up, judges are liars, cops are thieves and the people are sheep. Karme is a bitch. I have now been recieving some VA benefits also. I live in the upper midwest in a resort town, 2 acres of land with hundreds more behind me. I have a nice 2 bedroom home and 6 car garage, my car, a truck, boat with 115 hp, tractor, and a new 4 wheeler. I have savings accounts in 2 banks and can enjoy retirement easily. She has an old car, works temp jobs, lives in 1 room. She blew her 401K, has little left as she has had to sell everything. I had one of those days before Christmas where I was feeling generous, called her and left a message I had a check fot $1000 for her and call me back. She called my son and told him she would not call me as it is all my fault at what happened. I tore up the check, and bought myself a Glock 9MM and am getting my CCW. I am willing to fight and die to save my country, except for the first 100 miles on the left coast. The Bay area has driven out all military bases, people hate veterans and there is no respect for the law.

        By the way, here in Nevada the NRA helped us fight Bloomberg’s lawyers the last election, and also actually got the firearms registration that cast it’s shadow over the Southern part of my State for the last several years overturned last year. So my Southern Nevada brothers and sisters (Las Vegas) no longer have to register their handguns anymore. We are in fact getting our full Second Amendment back again, thanks in part to the NRA. The State you live in is lost, and if you think you can blame the NRA for what the millions of idiotic liberal voters have done to your gun rights there, you are in the same boat ..literally!

  5. The thing that all seem to have forgotten is that ANY gun restrictions on the American people by those that SERVE WITHIN our government IS TREASON.

    They have NO lawful delegated authority to monitor our weapons – how many we have or what kind, who open or CC carries, etc; matter of fact it IS in writing within the *Preamble to the Bill of Rights that it is a “forbidden” put on those that serve within our governments by the words “… not be infringed.”

    Like Obama, this is not the first act of treason Brown has committed. They, Obama and Brown, others, have committed numerous treasonous acts.   9. Essentially, someone can fabricate false allegations…for whatever reason…not having anything to do with public safety…and have one’s firearms confiscated without due process. Very discomforting for the overwhelming majority of responsible gun owners.

  10. It’s just another form of ‘Swatting’, only this one was put into law by the state’s legislators, so there is no consequence for the person who unjustly accuses someone.

    But I wonder – since the victims won’t be informed, and the police know they are armed, don’t police procedures call for a SWAT assault on the house? So how long until some homeowner wakes up to the door crashing in and starts shooting? Any damned criminal can shout ‘Police’, so I’d shoot because I know I’m not a criminal, and I’d assume it’s a home invasion.

    So how long will it be until some homeowner kills a cop breaking into his house? How long until the cops kill some gun owner’s wife, kid, or all of them? How many cops will get killed – or stop taking these assignments because they don’t want to kill innocent people?

  11. Its fortunate for me that I no longer live in California, though a lot of my family still does. I WOULD REALLY CONSIDER GETTING VERY NAUGHTY WERE I STILL A RESIDENT. I am old and tired, if it gets here I doubt there is not much to hold me back from starting the insurrection that is past due.

  13. I have been thinking of this problem for a long time. I have come to the following conclusions:

    Only politicians, and persons directly effected by gun violence are gun grabbing.

    The effected people are understandable when prodded by anti-gun grabbers.

    That only leaves the politicians. Could it be they want the guns because they are fearful? Have they done things in business or office that if the people found out, would come after them?

    Why do dictators turn on their own people? Are they afraid of them? Why? Are they afraid of the people retaliating for what they have done?

    Don’t we think we need to be electing better honest politicians? We need to be following the criminal justice laws and putting these corrupt politicians in jail. What we have been doing by tolerating these corrupt politicians have been encouraging them!

  14. Every person with a gun in Calf. needs the National Liberty Alliance.org more than ever. Each person who would can protect themselves from this by being prepared with a Writ of Habeas Corpus order to show cause. And should you be given summons to appear, turn to the NLA to have papers drawn up to put you as the plaintiff and the judge, Sheriff, St. Att. and even the Gov. as the defendant in a civil suite violation of your 2d amendment right to bear arms. But whatever you do, do not seek an attorney or a lawyer for they are with the State and you will lose.

  15. Without a shadow of a doubt if these regressive communistic democrats continue to attempt to restrict guns out of this society there will be push back somewhere. It can be no other way. Every law restricting guns is a violation of the second amendment. Regardless of what the supreme court rules. Yet so called conservatives controlling both houses of congress seems to make no difference whatsoever.

    Two wars started on American soil because of the desire by a government to take guns out of Americans hands. The revolutionary war with England and in Texas a revolutionary war against Mexico. If this does not demonstrate real American determination to protect our God given right to self protection, with or without the second amendment in our Bill of Rights, those desiring to take our weapons away nothing ever will and the lesson must be taught once again.

    Those of us intelligent enough to understand the history of the twentieth century, the bloodiest century in the history of the world, refuse to have to learn that lesson again. We refuse to be marched to open pits and shot in the back of the head, or rounded up and gassed, and buried in mass graves by our own government. It happened then and it can happen now right here if we allow our guns to be taken away. Make no mistake that is the goal of the gun grabbers. Total control. I for one will not conform.

    The above is just one reason why the electorate is so frustrated. There are others.

  16. Don’t comply even at the cost of what you hold most dearly. Make it very costly for the usurpers and their minions to conduct their treason and their declaration of war against the people of America. Start a QRF by starting a CPT in your local area. RTI your county Sheriff and county commission to see if they are in agreement with the gun grabbers or apposed to it. If they are apposed to it then supply them with decrees that have already been enacted in other states and communities around the country that protect the 2nd Amendment rights of their citizenry. If they are in league with the traitors then put them on notice of what the consequences are under the constitution for their treason. Make public notices to this effect, have your say and stand firm in it. When you stand up to these bullies they always run.

It’s time for action and I myself look to Oath Keepers , 10 thers, NRA, and all the rest of the CONSTITUTIONAL organizations throughout this country and the leadership of all to work together and coordinate a plan to let the traitors within our government know that we are not going to stand by and let this crap go on any longer. We need all the leadership of all organizations to put together a plan to do something as a collective group. We need to establish a UN of sorts of all groups, find common ground in order to send a clear message that their corrupt acts of treason will no longer be tolerated.
    I believe we all have common ground. We need to put a plan in place, work together and take action. We need to make a statement that clearly let’s all the state and federal government officials know they are not going to take any of our constitutional rights away. Standing alone we lose working together we can win. We can take our country back! We need a coordinated effort by all organizational leadership to get together find common ground and coordinate our activity.
    Again I will suggest that the millions of us peacefully march on Washington. We need to let them know we will no longer tolerate the out of control government representation we now have in place. We want our Republic back. We want them to uphold their oaths or we will remove them. Again this will require our leadership to reach out to others in order to establish a consensus. Once established we can set the date for our march with a clearly defined message. This sort or coordinated effort will definitely get the attention of all Americans and the Media. The time has come to act; we must take a stand or lose our country forever.
