This Vet Is Not A Threat: Idaho Sheriff Stands Down The VA

Breaking: The VA goofed and had to back down. The Bonner County, Idaho, Sheriff sent the Feds packing. How did the VA goof? The VA wanted another Veteran’s guns. The People said “NO!” and the Sheriff backed them. Awesome.

I’m lovin’ it! All over the place people are beginning to stand up for their rights, and for all of our rights.  I would like to invite all Oath Keepers to enjoy this brief video in which two State legislators and a solid good All American Sheriff stood up for a Viet Nam Veteran when the VA notified him that they were coming to inspect his house to remove any firearms he might have there. Here are three heroes:

Here is what I’ve gathered thus far. I will update this post as needed, as more info comes in.

The VA was going to arrive at the Veteran’s home at 1:00 pm on Thursday, August 7, 2015. They wanted to inspect him home to make sure he has no firearms. The community rose up, led by their Sheriff and some patriotic legislators, and they backed down the damned Veterans Administration,  which issued a statement at around 1:30 pm saying they were calling off the house inspection. Yay!

At the rally to defend this Viet Nam Veteran were three Oath Keepers chapters from Idaho and several 111%er groups.

Gun-confiscation fears lead to protest in northern Idaho

“I took an oath to uphold the U.S. Constitution and uphold the laws of Idaho,” Wheeler said. “This seemed appropriate to show my support. I was going to make sure Mr. Arnold’s rights weren’t going to be breached.”

During Thursday’s demonstration, the group at times broke out in song to sing “God Bless America” and pray while waving both the American flag and the “Don’t tread on me” flag. With a population of just 1,700, Priest River is near the tip of northern Idaho— a region known for its strong tea party roots and gun-rights activism.

2. The situation ended peacefully and John kept his guns. The VA Field Examiner did not show up today but is planning on coming there next week and we were assured will meet outside John’s house to discuss how to officially declare him competent.
3. The VSO that showed up today is helping point John in the right direction.
4. Sheriff Wheeler honored his oath and sided with the people and the Constitution.
5. Citizens from Idaho, Montana, and Washington stood together in the defiance of tyranny.

1. There was no follow up by the doctor for 8 months on whether he had recovered. Had this happened we likely would not have been there today.
2. The letter is a final determination by a bureaucrat, without any judge or jury. That is not due process.
3. There was no opportunity to appeal BEFORE his right to bear arms was taken away. That is guilty until proven innocent.
4. They are sending these threatening letters to many veterans (read some of the comments in posts below). How callous to put a massive amount of stress on this man who is recovering from a stroke.
5. This would have turned out different if we all had not been there.

    1. How will this prevent the Feds from punishing this vet by taking away his VA benefits, such as they are?

  1. Joseph Stalin said in 1933: ”The United States should get rid of its militias”. Those that serve within our governments did exactly that, and are working hard so that they never come back by going against the powers and authority DELEGATED to them. This is one FORBIDDEN TO THEM, and that IS in writing.

    Second Amendment: “A well regulated Militia, BEING NECESSARY TO THE SECURITY OF A FREE STATE, THE RIGHT OF THE PEOPLE to keep and bear Arms, SHALL NOT BE INFRINGED.”

    Infringed – “to encroach upon in a way that violates law or the rights of another”; “to do something that does not obey or follow (a rule, law, etc)”; “to wrongly limit or restrict”; “to wrongly limit or restrict “.

    I disagree with this statement. Understand that this is my personal opinion, but it is based on much information.

    Vets are bring targeted to be disarmed, lose control of their finances, and it matters not if they are capable or not. I believe that those that serve within our governments are doing this because vets are the greatest LAWFUL threat to those that are corrupt, and/or are serving in “agencies” for which the US Constitution does NOT allow.

    It IS the vets that are the “well regulated Militia” because they are the ones trained “according to the discipline prescribed by Congress” and have the LAWFUL and constitutionally assigned duties to:

    — Enforce the US Constitution (Supreme LAW and definer of our government) and each state’s Constitution (highest LAW of the state except when in conflict with the US Constitution),
    — Enforce and keep the “Laws of the Union” (which are constitutional laws ONLY),
    — Protect the country against all enemies both domestic and foreign, and
    — “to suppress Insurrections and repel Invasions”.

    I also believe that constitutional law enforcement, etc are on the “dangerous” to those-who-serve-within-our-governments list because they are also trained, but not quite like the US military (well, used to be the US military until Panetta, Dempsey gave authority over them to the UN – treason). Because they can be brought up to the appropriate standard required more quickly, so I believe that they are the next to, some are already having, “problems” from those who serve within our government.

    If you do not think that those that serve within our government are capable of Murdering them, you might take another look at the First Degree Murder powers (assassination powers) that Obama gave himself, and because it is NOT lawful here in America, all who serve within our governments and do NOT stop that treasonous act are also guilty of/complicit in each and every murder he and his administration commits. The “secret” judges are definitely committing First Degree Murder and whole slew of felonies, etc.

    Those this is an opinionated comment, it is backed by facts.

    US Constitution, Article 1, Section 8, Clause 15: “To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel invasions.”

    Clause 16: “To provide for organizing, ARMING, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress”.

    James Madison, Federalist 46 wrote: “Besides the advantage of being armed, which the Americans possess over the people of almost every other nation…”

    Nunn vs. State: ‘The right of the people to keep and bear arms shall not be infringed.’ The right of the whole people, old and young, men, women and boys, and not militia only, to keep and bear arms of every description, and not such merely as are used by the milita, shall not be infringed, curtailed, or broken in upon, in the smallest degree; and all this for the important end to be attained: the rearing up and qualifying a well-regulated militia, so vitally necessary to the security of a free State. Our opinion is that any law, State or Federal, is repugnant to the Constitution, and void, which contravenes this right”.

    Bliss v. Commonwealth: “Arms restrictions – even concealed weapons bans – are unconstitutional, since arms bearing is an individual right and the legislature may not restrict any aspect of such a right.”

    Cockrum v. State: “The right of a citizen to bear arms, in lawful defense of himself or the State, is absolute. He does not derive it from the State government. It is one of the high powers delegated directly to the citizen, and is excepted out of the general powers of government. A law cannot be passed to infringe upon or impair it, because it is above the law, and independent of the lawmaking power”.

    Andrews v. State explains, this “passage from Story, shows clearly that this right was intended, as we have maintained in this opinion, and was guaranteed to, and to be exercised and enjoyed by the citizen as such, and not by him as a soldier, or in defense solely of his political rights.”

    Joel Barlow, Revolutionary War veteran, wrote “Advice to the Privileged Orders, in the Several States of Europe”, clergyman, theologian, popular poet, successful diplomat, and American whose political writings were debated on the floor of Parliament said of the US Constitution: “… not only permitting every man to arm, but obliging him to arm.”

    George Mason: “When the resolution of enslaving America was formed in Great Britain, the British Parliament was advised by an artful man, who was governor of Pennsylvania, to disarm the people; that it was the best and most effectual way to enslave them; but that they should not do it openly, but weaken them, and let them sink gradually, by totally disusing and neglecting the militia.”
    and he also said: “That the people have a Right to mass and to bear arms; that a well regulated militia composed of the Body of the people, trained to arms, is the proper natural and safe defense of a free State.”

    Justice Robert H. Jackson (Chief of Counsel for the United States, Nuremberg Trials – Nazi Germany): “It is not the function of the government to keep the citizen from falling into error; it is the function of the citizen to keep the government from falling into error”.

    Like changing the sheets on the bed, it is past time to change those who are serving within our governments. They no longer abide by the “contract” that they are required to follow and they go way beyond it to actually committing crimes all the way up to First Degree Murder.

    This is NOT a revolution, as the ones who are in revolt are those serving within our government trying to change our government unlawfully and without the lawful authority to do so. All of their authority and powers are DELEGATED and put into writing.

    This is NOT a civil war either.

    This is merely removing and replacing those domestic enemies and traitors to the American people, the US Constitution, the USA and RESTORING our legitimate government by placing new people in the places of our government who can WILL follow the contract they are under when all other normal mechanisms for replacing and removing the corrupted, the treasonous, for doing so, have been conscripted such as Election Fraud, etc.

    1. What we’ve lost is the understanding that the federal government derives its authority under the several states and is not an entity unto itself. If a solution exists to clean house, as it were, it exists in and through states’ rights, or a quorum of states.

      1. DaveBinAZ, the US Constitution assigns the duty to “clean house” (if by that you mean to enforce the laws – that are the Constitutions (Supreme and highest in each state) or in Pursuance thereof the US Constitution – of the land to the Militias of the several states.

        The states, which were created ALSO by, and FIRST, by the people, used the people’s state representatives to create the US Constitution which defines the duties of those that SERVE WITHIN the general government.

        Each state retained its own government, but it was put into the supreme law the REQUIREMENT that its governmental form be republican in nature by the US Constitution.

        The states then DELEGATED some of their powers – mostly to deal with foreign affairs – to that general government. But the authority that both the states and the general government comes from the PEOPLE.

        All the Constitutions say something along this order usually found within the Preamble: “We, the People of the State of XXXXXX, grateful to Almighty God for our freedom, in order to secure and perpetuate its blessings, do establish this

        Preamble to the US Constitution: “We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”

        All governmental authority was delegated by us, “We the People” and it is written in present tense to make sure that all are aware of that.

        It is all in writing within the US Constitution what those that serve within the general (federal) government are ALLOWED to do, FORBIDDEN to do, and ALLOWED to do only under certain circumstances and in a specific manner. It is important to realize that all of that which is also put into writing within the US Constitution.

        It is also all in writing within each STATE Constitution what those that serve within that state’s government are ALLOWED to do, FORBIDDEN to do, and ALLOWED to do only under certain circumstances and in a specific manner. That state Constitution is the highest LAW of the state (except where it conflicts with the US Constitution) – NOT the people who serve within it, and no one can lawfully go away from those powers delegated if their service is governmental in nature – hired, contracted, elected, etc.

        The same goes for the US Constitution, except that IT – not the people who SERVE WITHIN IT – is the supreme law of this land, and no one can lawfully go away from those powers delegated if their service is governmental in nature – hired, contracted, elected, etc.

        The general government is NOT the supreme government, it LAWFULLY deals with mostly foreign affairs or things that concern all the states within the union, and those things that those who SERVE WITHIN the general government are ALLOWED to do are put into writing, listed within the US Constitution. It is always easy to see if/when they are overstepping the boundaries put up around those that serve within our governments – READ the US Constitution and the state Constitutions.

        It is important to understand that if it is NOT listed within a Constitution, it is not a duty of those who serve within our governments, it still is retained by the people as it was NOT delegated. Powers/authority that is DELEGATED may be revoked by those that delegated them.

        The problem we have is that we have people who serve within our governments that are working to destroy the US Constitution, our legitimate form of government who need to be replaced. They have taken over MOST lawful means of removing them; elections, recalls, etc so the last recourse is the Militia – and it IS lawful and constitutional.

        James Madison, Federalist 39: “Each State, in ratifying the Constitution, is considered as a sovereign body, independent of all others, and only to be bound by its own voluntary act. In this relation, then, the new Constitution will, if established, be a FEDERAL, and not a NATIONAL constitution.” (It was established, and it IS “federal”.)

        James Madison, Federalist 46: “The Foederal and State Governments are in fact but different agents and trustees of the people, instituted with different powers, and designated for different purposes… They must be told that the ultimate authority, wherever the derivative may be found, resides in the people alone; and that it will not depend merely on the comparative ambition or address of the different governments, whether either, or which of them, will be able to enlarge its sphere of jurisdiction at the expence of the other. Truth no less than decency requires, that the event in every case, should be supposed to depend on the sentiments and sanction of their common constituents.”

        Thomas Jefferson: “I consider the foundation of the Constitution as laid on this ground: That “all powers not delegated to the United States, by the Constitution, nor prohibited by it to the States, are reserved to the States or to the people.”To take a single step beyond the boundaries thus specially drawn around the powers of Congress, is to take possession of a boundless field of power, no longer susceptible of any definition.”

        Joseph Story, Commentaries on the Constitution: “Let the American youth never forget, that they possess a noble inheritance, bought by the toils, and sufferings and blood of their ancestors; and capable, if wisely improved, and faithfully guarded, of transmitting to their latest posterity all the substantial blessings of life, the peaceful enjoyment of liberty, property, religion, and independence… Republics are created by the virtue, public spirit, and intelligence of the citizens. They fall, when the wise are banished from the public councils, because they dare to be honest and the profligate are rewarded, because they flatter the people, in order to betray them.”

        Our grandparents, parents, etc did not “faithfully” guard, so we bear the burden of replacing the traitors and domestic enemies of our nation and RESTORING our legitimate government – state and federal. They trusted those they put into office and put our nation in peril. It will be our duty to restore the USA, and to see that those that serve are always watched carefully and held accountable, whatever position they occupy.

    1. The VA – fed government, and at this time, a large part of the medical service under “Obamacare” socialism is also governmental in nature, hence those that serve today within it cannot be trusted.

      They may not be willing, but they are still “just doing their job” in a way that works against our legitimate government.

      But that will all come out in the end AFTER we replace and prosecute the traitors and domestic enemies of the USA with those who WILL keep their Oaths.

  4. Obama supplies guns to known terrorists (via Fast and Furious, for example) and takes guns from patriots. Our own government arms our enemies and disarms our citizens! Sounds like blatent treason to me.

  5. Remember this event the next time you vote for your county sheriff. Ask yourself the question, “Would this candidate for sheriff actually stand up for the Constitution and the people in his county?” Bonner County, Idaho, Sheriff Daryl Wheeler stood up for his oath, the Constitution, and We the People. It is critical to elect more like him. (He is actually one of the reasons I live in Bonner County.)

  7. The VA has no damn authority to be confiscating a veterans gun whatsoever. The VA is supposed to be administering medical care NOT DETERMINING what our rights are. Our Constitution gives the people that authority! The true colors of the VA have been exposed and they are not red, white and blue.

    1. as usual a day late and a dollar short, pretty much what I was going to say, the VA has NO legal authority to enter the mans home, OR confiscate his private property, so not only did this fail a court requirement, it was intent of THEFT..

      the VA is NOT an ENFORCEMENT agency, they are a medical treatment facility, as such they should be reminded OFTEN that they have no ground to stand on.

      1. The VA is a federal governmental agency, and a LOT of the recent (last 50 or 60 years) agencies are NOT allowed to those that serve within the general (federal) government. Nor do those that serve within any of them seem to keep the Oath.

        The way I look at it, even doing away with the unlawful agencies, there are going to be a LOT of job openings.

      2. I know they are a federal agency, but they are not a federal law enforcement agency, this is the main point I was trying to make.

        If they where they would be a federal nationwide police force, which is a government standing army in opposition of the public at large, which is something the forefathers warned us about.

        either way, they, as a government agency, are bound by the laws and rules set forth in the Constitution, and the BOR, IE they need a warrant signed by a judge, and since they are not a court, they are not able to provide this on their own, nor are they legally allowed to deliberate a legal reason for seizure of property, or entrance into a private residence.

  8. It strikes me that a good lawyer could sue the VA management to get a court order to stop VA from doing any of this activity. The VA manager that authorized this action should be sued until he cannot afford to pay attention as well. Any management section that does this should be personally and individually sued for damages in the range of 5 million dollars to hold them personally responsible and to give them reason not to attempt these actions. Holding the government responsible for damages at every level would stop the VA from issuing these instructions to the managers in the VA centers.

    1. The courts are governmental agencies.

      The VA manager because of the Oath is personally responsible for all actions taken, BUT we have to investigate, charge where needed, and then prosecute under a constitutional judge – removing all who do NOT use the constitutionally REQUIRED “Good Behaviour” while in office.

  9. This is why I will not go to the VA for anything but medical care. I will NEVER speak to a VA psychologist or psychiatrist.

  11. The VA is only there to treat us vets. They have no business coming into our homes! I do not discuss any of my thoughts to them, just let them know where it hurts and where to send me my scripts!

  12. To be fair, the VA didn’t make a mistake. They were going by the information in the records filed about John Arnold. Whoever filled out the paperwork is responsible for everything.

  13. All these legalistic arguments make me tired. They make one appear impotent and ineffectual. I’m more with what Sam Adams had to say about it:

    “…No people ever yet groaned under the heavy yoke of slavery, but when they deserv’d it. …The truth is, all might be free if they valued freedom, and defended it as they ought. …If therefore a people will not be free; if they have not virtue enough to maintain their liberty against a presumptuous invader, they deserve no pity, and are to be treated with contempt and ignominy.”

    The response to the confiscators: a hail of bullets. Although I’ll admit it is preferable if you can get your neighbors to help you make the confiscators back down and run, with their tails between their legs.

  14. So, let me get this straight. A representative from the Veterans Administration, meaning a payed employee of the United States Department of Veterans Affairs, was going to physically come out to this Veterans home and check his home for firearms? What department within the Veterans Administration initiated this? I know that they provide information to the NICS in regards to Veterans, which in itself raises some serious concerns (patient-doctor confidentiality), but to have a payed employee of the VA come out to someone’s home is troubling.

  15. The VA should focus on providing support and surplus to veterans. It’s difficult to imagine the VA could have any authority to enforce and infringe on an individuals Constitutional rights without due process. The VA has become an organization riddled with cronies and tyrants operating among all ranks. The VA makes a habit of processing claims at their own pace, making decisions without warrant, and deliminating care in a way that seems to support a modus operandi that is systematic with self growth rather than a model that provides the services and surplus the organization was founded to provide. Americans should demand accountability and clean house with this sick organization from top to bottom and allow voters to manage the funding with complete transparency. The days of budgetary cronyism at the VA needs to end. The need has to be established by the veteran not the bureaucrat.

  16. I do applaude your stand. This should be a clarion call to action, broader and wider action. The Federal and State Governments exsist at your behest. Is anyone actually happy with the job they are doing? So the simple answer is to stop paying them for doing a crappy job of governing. If you want less infringement on your liberty don’t finance your oppressors. Stop giving them money, you are the only nation in the world that has the ability to throw off your shackles and denounce taxation at the individual level. You are armed and have the right to be armed.

    While I am at it, corporations are not people, they do not nor ever should have any legal standing beyond limiting the investors exposure to losses. They should not have any say in choosing or financing politicians. A politician that takes money from any company (or any lobbyist) is probably guilty of treason or a least a conflict of interest to the degree that they should be unfit for office.

    Fix these 2 problems and lead the way for the rest of the “free” world to follow.
