Police Chief Shane Harger of the Jemez Springs, NM Police Department was placed on administrative leave and ordered to disband his police department today.

Harger returned from the Constitutional Sheriffs and Peace Officers Association Convention on Monday, January 27, 2014 with a sense of knowing that, he as well as 38 other peace officers, shared the commitment to uphold and defend the Constitution of the United States of America from enemies both foreign and domestic. He and the other 38 men and women signed the Resolution of the Constitutional Sheriffs and Peace Officers Association (see below).

The following morning, Harger was informed by Sheriff Douglas C. Wood of Sandoval County, New Mexico, that Harger was to dismantle the Jamez Springs Police Department.

Jemez Springs, NM is a tourist destination. With a population of 252, the police department enjoys ten part-time officers and volunteers with many working about 8 hours per month.

The story unfolds: Traveling by commercial airlines from Albuquerque, NM to LasVegas,NV, Harger was asked by TSA to show his credentials. Minutes later a man flashed a badge claiming to be a federal agent (agency unknown) also demanding to see Harger’s credentials.

Harger was told that he was a person of interest, and the federal agent wanted to know where he was going and why. Bear in mind, no one is required to provide this information under these circumstances.

Harger said that the federal agent told him that the he, the federal agent, was paid to be suspicious of everyone.

Harger informed the federal agent that he was traveling to attend the Constitutional Sheriffs and Peace Officers Association Convention in Las Vegas.

Harger was detained for thirty-five minutes – his detention was video recorded but not made available to Harger.

Harger was eventually released from detention and was allowed to board the airplane.

No charges were filed against Harger.

I met Chief Harger at the Constitutional Sheriffs and Peace Officers Association Convention and was interested in the events of his travel. He agreed to be on the air with me on to tell the story of his detention as a person of interest who was attending a Constitutional Sheriffs convention. But before going live on global radio, Harger was fired as well as the rest of the police department.

Despite having received a meritorious commendation from the Mayor of Jemez Springs on January 22, 2014, it seems that no one in the village government is willing to come to the assistance of Harger. It appears that Harger’s stance to defend and uphold the Constitution has put him and his entire department of ten part-time and volunteers out of business.

Harger has received no reprimands, no correspondence of wrong doing, and nothing indicating that any of his actions were not in accordance with the law.

Harger stated to me that his department was ordered by Sandoval County, NM, Sheriff Douglas C. Wood to disband because of Harger’s political affiliations, specifically the CSPOA headed by founder Sheriff Richard Mack. I called the Sheriff’s Office to discuss this with Sheriff Wood, but was directed to his secretary’s voice mail. Here is the public number that I called – 505-867-7526.

I was at the convention and I never saw nor heard anyone say nor do anything that was a violation of any law. The CSPOA convention was an assembly of peace-loving Americans who just wanted to uphold their oath of office, that being to support and defend the US Constitution and Bill of Rights for all of us, We The People.

Chief of Police, Shane Harger is standing up to defend We The People, I trust that you will stand up to defend and support him. Anything less is unacceptable.

  3. This screams of being false. As far as I know, no Sheriff can just “disband” a police department or relieve a Police Chief of duty.

    Also, there is no validation anywhere besides this site, and InfoWars.

  4. actually, sounds like the infowars commenters did. This is NOT true. The chief was placed on admin leave for other stuff and wants to cover his ass by blaming it on his trip…NOPE. The false claims hurt our cause worse than if it were true.

I’ve been looking through the NM Constitution, and I can’t find any authority for a sheriff to “disband” a duly constituted municipal police force, even a volunteer one…this is something the town council would have to do, from what I can see, but it something I’ll bounce off my judge pal from Rio Rancho.

  7. I remember recently there was a server at a restaurant somewhere back East. She claimed a couple of customers had written on their bill something to the effect, they did not feel right in giving the server a tip because they did not agree with her lifestyle. This issue made national news, how dare they not tip for great service because of the servers lifestyle?! As it turned out, there was quite a bit more to the story, wasn’t there?

    I have known Sheriff Doug Wood for many, many years. I have worked with Sheriff Wood in a law enforcement capacity as well as a civilian capacity. I have always known Sheriff Wood to he of the highest integrity. As a retired law enforcement officer myself, as well as a lifelong citizen of the state of New Mexico I do know the Sheriff of any County can not ORDER the termination of a municipal employee, in this case the Chief of Police, much less the disbanding of a police department. The statement made that he did this is unbelievable in itself.

    As stated before, I really believe there is quite a bit to this story and I for one look forward to seeing the truth of this matter

  9. Arrest Sheriff Douglas C. Wood, strip him of all his credentials, put him on trial and, once he’s found guilty of violating his oath, throw him in one of Sheriff Arpaio’s detention centers, pink underwear, bread and water, etc.

    Operation American Spring is an ill conceived idea.
    -Running for your local school board.
    -Attend school board meetings, city council meetings.
    -Go speak to your local sheriff about Oathkeepers
    -Joining the PTA.
    -Becoming a youth sports coach or just assist the coach occasionally.
    Be a positive role model to young people and encourage them to succeed.
    Coaches and sports altered my life course towards the positive. Made a difference.
    -Becoming an Apple Seed Project instructor.
    -Making your own one page News Letter to inform EVERYONE in your neighbor hood
    about the USA Obamunista military command structure PURGES.
    -Becoming a reserve police, fire, sheriff, volunteer.
    -Becoming a HAM radio, point to point com radio specialist
    -Getting basic first aid/cpr certs
    -Calling ten people everyday of your life to discuss the PURGES,
    unlawful obamunista acts, “encourage those ten to also contact
    Ten people and push for Impeachment and Arrest.
    In my mind any of the above are more constructive than American Spring.

    Politicians only understand ONE thing. FIRING them. IMPEACHING them.
    Arresting them. Get them out of office. Politicians are indifferent to
    your protests. They do NOT listen. They do NOT care.

    A protest gives the enemy propaganda, also an excuse to beat, jail, murder.

    Non Compliance. Not Obeying. Massive disobedience to idiocy. Ignoring unconstitutional legislation and “laws”. Just ignore them. Never Register yourself or your weapons.

  11. According to the Jemez Springs Police Department, they are a substation of the sheriff’s office. It would seem to me that if the Jemez Springs government wanted to maintain their own police force, they could simply create and hire their own officers and not be a “sub-station”.

And thank you Tim, I just don’t see where we have the luxury of much time left to bring these things to fruition. It’s been years now and nothing truly significant has happened to turn back the tide. I mean the thousand bikers was a good try, but there wasn’t any one willing to stay behind to finish the job and not nearly enough people.
    I know I get it that there is always a chance that some nut would bring a gun or that there could be a plant from the gov. to fire a shot and blame it on the patriots, and that I guess would be my biggest concern at this point.Thanks again for your replies.

  13. One article I read state that he had a driver license with a different name? Could this be a problem? Two different identities? Why? Either way, he does have a right to be an Oath Keeper as many LE departments across the country at different levels have all signed the Oath Keeper Oath. It is in their oath to follow the Constitution. I think there is more to this story, but don’t feel we will get the full story, so I’ll hold my thoughts on this as I’ve read several accounts and not everything that went on is reported on all sites. Everyone has an agenda, we don’t always know what it is.

  16. His CSPOA association is not the problem or issue here. The man has two different identities. The TSA caught the two names. They were only doing their jobs. How do we not know that Mr. Harger / a.k.a. Hayes did not cop attitude or send up even more red flags? He has recently stated that the name change is because he was a first responder of an alleged homicide of a law enforcement officer’s wife. What people should be asking about is the criminal investigation in his previous employment, Guadalupe County SO, Santa Rosa , NM, that led to him changing his name. He did go to the Feds but only after violating civil rights himself. He has had other law enforcement employments which also did not end well including but not limited to Taos, NM where he cost taxpayers a lot of money for violating civil rights there also. I see a pattern. Oath Keepers can keep him though I would think they would screen for more integrity.

  17. I read the same thing about Shane Harger having 2 names – Washington Tomes is now running the story. I don’t know WHO I’m more upset with: the TSA or this guy for apparently not telling the whole truth about why/what happened! If we can’t trust those who we THINK are on our side, then it’s pretty darn sad. I do know one thing, though – Oath Keepers needs to investigate this and update this post or take it down. It gives us no credibility leaving it up as is…and we’re all under enough scrutiny to begin with. No sense adding fuel to a fire that might burn US….

    not offense. They were fired on first. If we do this OAS
    they will have an excuse (however evil) to open up and unleash
    everything at their disposal on us. Its a VERY bad idea. I think
    we are doing just fine. BUT if they were to come to our towns
    and start confiscating guns and imprisoning Patriots we have the
    DUTY to stand our ground and resist with any means at our disposal.
    We can and will protect our families, towns, Counties and States.

  19. This all started with TSA Marshall @ ABQ airport. Listen to three (3) separate interviews with Chief Harger, Sheriff Mack. It’s about harassment and threats against Constitutional 4th amendment. After the event at the airport &CSPOA convention, the TSA Marshall had contacted the Sandoval Cnty Sheriff Dept (outside the airport jurisdiction) a meeting with the mayor, city council, TSA, FBI & DHS convened and Chief Hargar stated he was not given due process to ask or answer any questions. interview starts at audio time 1:07:50 with Chief Harger, then Sheriff Mack interview; time 1:41:50; @ time 1:45:55 Sheriff Mack is asking all listeners to download the contract at CSPOA and join for $35 to grow the numbers and financial support for instances like this against Sheriff Finch (FL) and Chief Harger.

    There will be more to come as this is making national attention due to the abuse of TSA and violating ALL citizens rights to travel freely without detention. Constitutional and civil rights were violated without warrant. I think the above article was written in such a way it is a little misleading.

  20. The TSA and the media are trying to make this all about the fact that I had an undercover ID. The fact is that my boarding pass and my id and my social security card and my law enforcement id all match. What more should they be provided?

    He used to run undercover for LEO’s. Amazingly enough, they use a DIFFERENT ID when they do that for protection. Learn a little about law enforcement before you spout off about something a LEO does in an accusatory manner. (And Yes, I also critic them, but I base it on FACTS.)

    The TSA KNEW before hand because he went and spoke to one before, showing and verifying his lawful ID. So that also falls thru the cracks as more BS.

    But THIS, is appalling, “They were only doing their jobs.” What part of what that job requires them to do is lawful?

    The Constitution and US statute do guarantee unencumbered access to fast transportation such as flying:
    “A citizen of the United States has a public right of transit through the navigable airspace.” 49 US Code-Section 40103 (2).

    AS you can see – NONE of it. Guess you never heard of the US Constitution and all that is “IN PURSUANCE THEREOF” it IS the highest law of THIS land; plus that each state has a Constitution which is THE highest law of that state except where it overlaps the US Constitution and all that is “IN PURSUANCE thereof” it.

    US Constitution, Preamble to the Bill of Rights: “… THE Conventions of a number of the States, having at the time of their adopting the Constitution, expressed a desire, in order to PREVENT MISCONSTRUCTION OT ABUSE OF ITS POWERS, that FURTHER declaratory and restrictive clauses should be added: And as extending the ground of public confidence in the Government, will best ensure the beneficent ends of its institution…”

    Amendment IV: The right of the people TO BE SECURE IN THEIR PERSONS, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

    Art IV Sec 2, the 14th says, “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States”

    The rights enumerated in the Bill of Rights were not granted by the Amendments and are not dependent upon the Constitution for their existence. The Court also ruled that the Amendments were restraints on the powers of the federal government and it is the duty of States to secure the individual rights of the American people.

    Supreme Court case of West Virginia Board of Education v. Barnette, Justice Robert Jackson:
    “The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts.” 

    Supreme Court, Miranda v. Arizona, 1966: “Where rights as secured by the Constitution are involved, there can be no rule making or legislation which will abrogate them.”  

    Supreme Court, U.S. v Miller, 1939: “The claim and exercise of a constitutional right cannot be converted into a crime.”

    They do not now, nor have they ever had, they LAWFUL authority to search our persons, etc – EVER.

    There is NO SUCH THING AS “emergency powers”. The closest thing to “emergency powers” those who SERVE within the US Constitution are given access to use also suggests the lawful remedy for the problems. It is NOT the “Patriot Act”, NDAA, NSA, etc.

Intelligent and cogent, indicative of an individual using his mind to discern between right and wrong, lawful and unlawful. It is indeed unfortunate that such clarity is sadly lacking in all aspects of society. A persistant sign of the failure and collapse of our educational system and spiritual decline. Moreover the replacement of cognitve and reasoning skills used in a collaborative effort with a full command of the facts, etc., to pervasively ignorant and childishly emotive responses to deceitful ploys. What is sadder still, is this cry for leaders and laws of inconsistency, divisiveness and lack of cohesion while the answers are in the simplest of precepts and concepts that were implemented through in what is our Constitution. Is it perfect? Not quite, but is still the best man made philosophical response to governance and conduct ever to have been put down on paper and implemented with the best of intent and purpose. Now it is smothered with false premises, assertions and hypocracy. Adminstered to by an avaricousness that is blinded by pompous, asinine persons drowning in their delusions of grandeur.

    In other words, “way to go”! 🙂

I just talked to the second in command at the Sandoval County Sheriff’s Office, Carl Wiese, who said that Sheriff Wood is one of us in that he stands close to his oath to uphold, protect and defend the Constitution as well. Sheriff Wood did not tell Shane Harger to disband his police force. All Sheriff Wood did was tell Shane to give back his membership card to the Sandoval County Sheriffs department (after asking him to call him; which Shane didn’t do). Why? Because he didn’t really know if Shane Harger is really “Shane Harger” or “Braxton Haze”. When TSA detained Shane at the airport, it was because he had a boarding pass that had Shane Harger on it but his I.D. card said Braxton Haze.

    If you weren’t able to get through to Sheriff Wood, like I was wasn’t, it’s not because he disappeared, it’s because he has been absolutely swamped with calls.

    My suggestion is to get all of the facts from both sides first before passing judgment. A little diplomacy goes a very long way to finding out what really happened. To Shane Harger or Braxton Haze, do what you have always professed to do: Stand by your oath to tell the truth, the whole truth and nothing but the truth so help you God.

  25. While a Valencia County NM Sheriff’s Deputy, Shane Harger was the first responder at the home of
    an ALB NM police officer. A murder investigation ensued. Witness protection name change followed
    to protect Shane Harger as a potential Witness. He reverted back to his real name after the lengthy trial. If this much trouble is the result of being a first responder, best to let a rookie take the bait and fall on his sword. More convenient, less risky to then show up after the crime scene is taped. This has far reaching implications, of which no officer desires to be involved. Shane Harger

    My question would be… Where does the Justice Department get introduced to both sides of the Civil Rights issues at both ends of the spectrum?

    The Constitution is the supreme law of the land, not the FBI.

  27. The source for this piece explains much of the misinformation and incorrect facts. A brief look into the writings of “Vincent Finelli” shows a long history of a rather delusional individual who is convinced that pretty much everything is a govt plot to opress either the people in general or Mr. Finelli himself. Given that some in the mainstream media already hava a bias towards OathKeepers as a racist, right-wing, conspiracy site, the integrity of OathKepper’s would benefit from a moderator doing fact-checking before this kind of story get’s cleared for publication.

    Publishing such a poorly researched piece from a known conspiracy mill-house does not server OathKeepers well.

  29. It seems that there are a number of differing opinions concerning this issue. One would think that the Oathkeepers would have a member or two either in Jemez Springs, or somewhere nearby. Above, a genteleman named Adrian says he is a resident of the town, and should be able to get the skinny on the details!
    no sheriff has the right to disband an entire police department. Even if the chief did commit crimes that would cause him to be put on administrative leave, there is no valid reason for the rest of the department to be dissolved! That also constitutes a danger to the residents.
    Also the boys from NM helped us out in Quartsite a couple of yrs ago. Don’t we we owe them our assistance in return?

  32. Well, something is rotten in Denmark,,,,So 1st this story comes out, this happened in Jan, 2014,,,NOW in Aug,2014……the following story comes out !!! SO which one is true ?? Seems odd that he would be charged with rape in Aug,2014 , BTW the woman he’s charged with raping is the girlfriend of a drug dealer he arrested, AND she did not give testimony before the Grand Jury , also thanked him for treating her well at the time this was supposed to have happened….I DON’T KNOW WHAT THE TRUE STORY IS HERE, BUT IT’S VERY FISHY INDEED….
    ALBUQUERQUE (KRQE) – A man who used to run a New Mexico police department is now facing charges that he raped a woman who was in his custody.

    New Mexico state police arrested former Jemez Springs police chief Shane Harger Thursday.

    Investigators say they’ve been looking at the case since January, just a month before Harger was fired from his position with Jemez Springs police.

    News 13’s cameras were rolling as Harger was walked by state police officers to their Albuquerque office on Thursday afternoon, shortly after he was taken into custody in Edgewood.

    When asked Thursday if he had anything to say about what happened, Harger did not respond and kept his head down as officers walked him away in cuffs.

    Harger is charged with kidnapping, two counts of rape and extortion.

    State Police say Harger pulled over a car in early January while he was still the Jemez Springs police chief. Police aren’t saying why the car was pulled over, but News 13 has learned that police found heroin inside of the car.

    According to state police, another officer took three men inside the car into custody and two of them were charged. Meanwhile, Harger took the woman alone.

    A Sandoval County grand jury indicted Harger Thursday. The paperwork says Harger illegally detained the woman, then touched the woman’s private parts and raped her. State Police say the woman was released three hours later after she was taken into custody and was not charged.

    The indictment says Harger then threatened the woman with charges if she told anyone about it.

    This isn’t the first time Harger has been in the news for his questionable behavior.

    Harger got in a heated argument with TSA and Albuquerque Police at the Albuquerque Sunport in late January when he was trying to get past security screening with identification cards that had two different names.

    The incident was caught on camera and happened after the alleged rape. It ended with Harger appearing irritated. Meanwhile, a security agent was heard saying “You know, in my opinion, he’s a poor excuse for police chief.”

    Harger was fired by Jemez Springs Village Council in February, but at the time they wouldn’t say why.

    New Mexico state police pulled Harger over Thursday in Edgewood and arrested him.

    “It can give all of law enforcement a bad name when something like this happens… and nobody that takes this job serious and wants to do a good job appreciates this kind of behavior from anybody wearing a uniform,” said Sgt. Damyan Brown of the New Mexico State Police Department.

    State police say Harger was taken into custody without any problems. He’s now awaiting a court date in the Sandoval County Detention Center.

    Harger’s attorney issued a statement Thursday to address the charges:

    “Mr. Harger is innocent of these charges and that will be proven as this case moves forward. This is yet another instance where police officers must be forever vigilant when they take people into custody. The fact that the alleged victim in this case did not testify before the grand jury panel is telling about her own credibility.”
