Secret Assassinations Courts? You’ve Got To Be Kidding Me!

As Judson Berger said in an article:

It sounds like an Orwellian idea from a futuristic sci-fi movie. Government officials gather in a secret courtroom, poring over documents and weighing whether to approve the fly-by killing of a suspected terrorist.

If the judges say yes, the target dies. If not, the target lives.

Also from the Fox article:

Sen. Angus King, I-Maine, is pushing the idea the hardest.

According to his vision, the drone court would be an avenue for U.S. officials to argue in secret before a judge why an American citizen should be targeted for death. He said it would be like “going to a court for a warrant” and proving probable cause.

Except in this case, the judge would be ruling not on a search warrant or a wiretap — but a missile strike from thousands of feet in the air, and thousands of miles away.

“If you’re planning a strike over a matter of days, weeks or months, there is an opportunity to at least go to some outside-of-the-Executive Branch body like the FISA court in a confidential and top-secret way — make the case that this American citizen is an enemy combatant,” he said.

It looks to me that Brennan and the Senators who are pushing this idea are doing so to create cover for Barack Obama, who has claimed the sole power to decide who lives and dies. Rather than Obama taking the heat for ordering the death of American citizens, (or foreigners, for that matter), prosecuted and judged in secret, the blame is shifted to the new Assassination Court. Excuse me, but an assassination is still a murder, no matter who authorizes it. Will these Assassination Courts give the target the opportunity to refute the evidence? Of course not. The target’s will have no standing in the Assassination Court. There will be no Rights of Habeus Corpus. No trial where the defendant can present evidence. The defendant will not even be aware the proceedings are taking place. The “Trial” will be conducted in secret.

What has happened to this once proud Nation, that was born believing in the Creator given Rights that many men have fought for, and died for? Are we so afraid of men, whom we label terrorists, who live in the shadows, or in caves in Afghanistan, or the deserts of North Africa, that we have abandoned those Rights our ancestors died fighting for? Do we dishonor them to such an extent as to negate the sacrifices they made?

The Constitution of the United States delegates the power to declare war to the Congress. It has not declared war since WWII, yet our troops have been sent to die in many engagements since 1945, the end of the last declared war. They have lacked the integrity to do so. And they wonder why the American public holds them in such low esteem in the polls.

The only wars Congress has declared, are the War on Poverty, the War on Drugs, the War on Terror, and now the War on Guns. Think about these four so-called wars for a minute. These are not wars against a particular enemy. They are wars on inanimate objects, (drugs and guns), or concepts, (poverty and terror). These wars, being vaguely defined, can last forever. The War on Terror, being the most vaguely defined, is meant to last forever. It is meant to be used to deprive us all of our Creator Given Rights, as well as the Rights inherent within the Constitution.

The Patriot Act was written before 9-11 occurred. It was waiting for an opportunity to be thrust upon us. That opportunity came when 9-11 shook our World to the core. We had been attacked by a bunch of “terrorists”, the authorities claimed, necessitating the War on Terror. Since that fateful September day, more and more of what used to labeled simply, crimes, are now labeled as “acts of terror”. Terrorists have no rights, according to the FedGov. They are “enemy combatants” and can be killed on sight, if the authorities choose to do so. More and more of our citizens are being labeled as “subversive elements” by the Department of Homeland Security. The list grows longer and longer. Returning Vets have been singled out as potential subversive elements, along with Ron Paul supporters, Constitutionalists, (Think about it, those who believe in the Constitution are labeled subversives!), and others.

The Constitution we hold dear is being ignored, or perverted, by those who would label our Veterans potential subversives. It isn’t enough that we send our military into harm’s way. Their sacrifice is not enough to give them respect and honor. No they are treated with suspicion by the very Government that sent them in harm’s way. It is surreal! It is Orwellian!

Does the creation of a Secret Assassination Court mean that the “targets” will get a fair hearing? Of course not. They are merely targets, and those who will condemn them to death will be guilty of murder. War on Terror? Terror is merely a concept, like freedom, capitalism, feudalism or collectivism. I have an idea, let’s start a War on Liver. I hate liver. We can have a Secret Liver Assassination Court. But don’t tell anyone. After all, it is secret.

    Cal Says:

Justice Robert H. Jackson, Chief of Counsel for the United States, Nuremberg Trials:
“It is not the function of the government to keep the citizen from falling into error; it is the function of the citizen to keep the government from falling into error”.

Those ’serving’ in our governments have fallen into error.

Patrick Henry: “The Constitution is not an instrument for the government to restrain the people, it is an instrument for the people to restrain the government.”

    Yet, we have not.

Daniel Webster: “Where is it written in the Constitution, in what article or section is it contained, that you may take children from their parents and parents from their children, and compel them to fight the battles of any war in which the folly and wickedness of the government may engage itself? Under what concealment has this power lain hidden… Who will show me any Constitutional injunction which makes it the duty of the American people to surrender everything valuable in life, and even life, itself, whenever the purposes of an ambitious and mischievous government may require it?”

WEll, where is it written, when ALL laws, bills, treaties, amendments, etc MUST be in “pursuance thereof” the US Constitution to be lawful here in the USA? Where?

Hamilton: “When will the time arrive that the federal government can raise and maintain an army capable of erecting a despotism over the great body of the people of an immense empire, who are in a situation, through the medium of their State governments, to take measures for their own defense, with all the celerity, regularity, and system of independent nations? The apprehension may be considered as a disease, for which there can be found no cure in the resources of argument and reasoning”.

Cockrum v. State: “The right of a citizen to bear arms, in lawful defense of himself or the State, is absolute. He does not derive it from the State government. It is one of the high powers delegated directly to the citizen, and is excepted out of the general powers of government. A law cannot be passed to infringe upon or impair it, because it is above the law, and independent of the lawmaking power.”

The Supreme Court has cited St. George Tucker – a lawyer, Revolutionary War militia officer, legal scholar, and later a U.S. District Court judge – in the major cases of virtually every Supreme Court era. He wrote of the Second Amendment:

“The right of the people to keep and bear arms shall not be infringed, and this without any qualification as to their condition or degree, as is the case in the British government.”
Yet, they keep “regulating” and banning; and requiring us to “register”.

    And
“This may be considered as the true palladium of liberty… The right of self-defense is the first law of nature…”

    And

“The congress of the United States possesses no power to regulate, or interfere with the domestic concerns, or police of any state: it belongs not to them to establish any rules respecting the rights of property; nor will the constitution permit any prohibition of arms to the people;…”

None of the other branches have ANY lawful regulation or lawmaking, or war declaring powers. None of this that has been going on within our nation is lawful by any stretch of the imagination.

Richard Henry Lee, Senator, 1st Congress: “To preserve liberty, it is essential that the whole body of the people always possess arms and be taught alike, especially when young, how to use them.” And

    And

“A militia… are in fact the people themselves … and include all men capable of bearing arms.”

John Adams, 2nd US President: “You have rights antecedent to all earthly governments; rights that cannot be repealed or restrained by human laws; rights derived from the Great Legislator of the Universe”

Abraham Lincoln: “We, the people are the rightful masters of both Congress and the courts, not to overthrow the Constitution, but to overthrow men who pervert the Constitution.”

James Madison, Federalist Papers 46: “They must be told that the ultimate authority, wherever the derivative may be found, resides in the people alone, and that it will not depend merely on the comparative ambition or address of the different governments, whether either, or which of them, will be able to enlarge its sphere of jurisdiction at the expense of the other.”

George Washington, Farewell Address: “If in the opinion of the people … but let there be no change by usurpation; for though this in one instance may be the instrument of good, it is the customary weapon by which free governments are destroyed.”

Thomas Jefferson, 3rd President of the United States: “On every question of construction (of the Constitution) let us carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested in the debates, and instead of trying what meaning may be squeezed out of the text, or invented against it, conform to the probable one in which it was passed.”

    And

“The greatest danger to American freedom is a government that ignores the Constitution.”

    Misfit Says:

Quotes really? Our responses to the ultimate crime against the citizenry are quotes from the Founding Fathers? Really? I have been active in communicating with my community and neighbors to wake them up until I am blue in the face, unfortunately, many are too scared and intimidated as to what the government is doing and all I see my fellow Patriot doing in response is placing quotes?

The quotes are great and all but they are not communicating ideas on this blog as to what we are doing to correct the problem. What actions have you taken? Tell us what efforts you have done to awaken your community, your neighbors, and your state governments. Share what has worked with us what has worked for you so it will aid us in our efforts.

We are all very familiar with the Founding Fathers Quotes. Stop wasting time and let’s get to work on saving this great Nation! Let’s start networking with each other and banding together in our efforts. Community and state leaders notice large organized peaceful groups. Start by finding out where the like-minded Patriots are in your area and go to your local and state governments and demand to speak IN PERSON with your elected representatives. It will send a strong and clear message.

There, I have given you the first steps, now let’s get to work!

There will be some or many whose feelings may be hurt by my honest and brunt point, and if you are? Too bad!

    In Liberty!
