Gilberton Borough Council adopts 2nd Amendment Preservation

Resolution on January 24th

In what may prove to be an historic development, the Gilberton Borough Council Thursday night passed Police Chief Mark Kessler’s 2nd Amendment Preservation Resolution, thus nullifying within the boundaries of the Schuylkill County borough “all federal, state or local acts, laws, orders, rules, or regulations regarding firearms, firearms accessories or ammunition” not conforming to the US Constitution’s Second Amendment or to Article 1, Section 21 of the Constitution of the Commonwealth of Pennsylvania.

Mayor Mary Lou Hannon endorsed the measure, which was approved unanimously by Council members Daniel Malloy, Eric Boxer, Lloyd George, Susan Schmerfeld, and Robert Wagner, upon which approval Council observers in the standing-room-only water treatment facility meeting place erupted with an extended and enthusiastic round of clapping. “Let freedom ring,” was the Mayor’s victorious response.

Oathkeepers member Larry Liguori presented Chief Kessler with an Oathkeepers t-shirt, and Sunbury State Constable Ed Lee offered some congratulatory words, who himself has taken steps to nullify provisions of the 2012 National Defense Authorization Act (or, NDAA) as well as the USA PATRIOT Act and the 2012 extension of a number of its original provisions.

2nd Amendment Preservation

A Resolution of the Borough of Gilberton, which shall be known and may be cited as the “2nd Amendment Preservation Resolution.”

WHEREAS The 2nd Amendment to the Constitution of the United States reads as follows, “A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.” Along with Article 1, Section 21 of the constitution of Pennsylvania which states, “Right to Bear Arms.” “The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.”

WHEREAS to prevent Federal, State or local infringement on the right to keep and bear firearms, firearms accessories or ammunition; nullifying all federal, state or local acts in violation of the 2nd Amendment to the Constitution of the United States along with Article 1, section 21 “Right to Bear Arms” of the Pennsylvania Constitution.


The Council of the Borough of Gilberton within the state of Pennsylvania finds that:

A. All federal, state or local acts, laws, orders, rules or regulations regarding firearms, firearms accessories or ammunition are a violation of the 2nd Amendment along with Article 1, section 21 of The Pennsylvania Constitution and in violation of this resolution.

B. The Council of the Borough of Gilberton within the state of Pennsylvania recognizes that all Federal,State or Local acts, laws, orders, rules, regulations – past, present or future – in violation of the 2nd Amendment to the Constitution of the United States and/or Section 21 of the Constitution of Pennsylvania are not authorized by the Constitution of the United States and/or the Constitution of Pennsylvania and violate its true meaning and intent as given by the Founders and Ratifiers, and are hereby declared to be invalid within Gilberton Borough and all of its boundaries, and shall not be recognized by this Council and are specifically rejected by the Borough of Gilberton within all of its boundaries within the state Pennsylvania, and shall be considered null and void and of no effect in the Borough of Gilberton within the state of Pennsylvania.

C. It shall be the duty of the Governing body of Gilberton Borough or the Police Chief to adopt or enact any and all measures as may be necessary to prevent the unconstitutional enforcement of any federal, state or local acts, laws, orders, rules, or regulations in violation of the 2nd Amendment of the Constitution of the United States along with Article 1, section 21 of the Pennsylvania Constitution “The right to keep and bear arms”.

    I will stand shoulder to should with any law enforcement anywhere in this country that defend the 2A and Constitution and Bill of Rights. This is the type of man we need now. A TRUE AMERICAN AND FAITHFUL SERVANT OF THE PEOPLE.

    This is good, If “We the People” around our nation say “No” it can make a difference. Every oath breaker has not only committed a political offense, but also both a civil and criminal offense.

    Take Feinstein; legally she no longer meets the requirements of the position she occupies. She also can be arrested and prosecuted for her crimes. Yet, in California the Governor and the state AJ ignores the laws of this land, and the laws of the state.

    Two years ago was an unbaised poll (if there is such a thing):
    How concerned are you right now about contempt for the US Constitution?
    Very concerned 61%
    Somewhat concerned 21%
    A little concerned 8%
    Not concerned at all 10%

    It shows that that even then people were worried about what is happening to our legitimate government. I wonder how big a change there would be if it was taken today.

    People are aware that we have foreign troops on American soil, considered a threat by most here in the USA.
    We have our Military driving military vehicles and training in our cities here in the USA, which is unthinkable, and definately threatening.
    The UN (which has no legitimate authority here in the USA) came to “monitor” our elections, which is also seen as a threat.
    Most people understand that the corporate media is not telling the truth, which is why they have lost so many viewers – and this is viewed as unprecedented here in the USA. The people trusted where they got their information, and to find it betrayed their trust, well…
    Then the law enforcement started behaving as if they are military soldiers in a third world nation.
    Shariah and International laws used in US courts is also considered unprecedented, and has reinforced that our courts cannot be trusted either.
    And much more…

    This is why Americans have been, and are, buying weapons and ammunition. They feel threatened in their own nation. They don’t understand when clear crimes by corrupt individuals have been committed and there are NO arrests (example: no one has the “right” to give themselves assassination powers under our laws, it is just “murder” with a fancier name, Everyone recognizes that here in the USA).

    They are very aware that our elections are anything except “ours”. That “elected” officials are really “put into” office. That election fraud was committed in every state and no arrests, no prosecutions.

    They may not agree that Obama is, or is not, a “citizen”. But they agree that what he, and his administration has been doing is not what they was “elected” to do.

    These things and more, is why small towns, and Americans everywhere are (mostly silently) arming themselves. Why they are speaking out, hoping that this can be stopped by words, and lawful actions, wondering why those who are in law enforcement can be trusted because they have not been doing the job they were hired to do (election fraud, corrupt representatives at state and federal level). When they see the ones who speak out they count them, and keep count. They note where they are and are the words they are speaking matching with what that particular state county’s actions are. They try to figure out who can be trusted, when they are fairly certain that list is short.

    The arming is if the words and resoulutions of the people do not work against domestic enemies and treasonous representatives firmly attached within our federal government. The Bills, resolutions are attempts to stop the unlawful actions; are steps they are being taken, with hope that they work. The arms are in case they do not – because few believe that officials in this nation will follow the laws, and the officials in higher offices that have the trust of the people can be counted on one hand.

    But the lawful attempts must be made, this is the USA after all.

    I congratulate the town on taking this step. One thing I see missing from this resolution is the teeth to uphold it. What will the town do if state and federal agents come to take weapons? What will they do if sanctions are placed on them? What will they do if their citizens are turned into criminals overnight?

    Switzerland has the lowest crime rate in the world,because the people are armed,basic military is mandatory for men,and after wards they are required to keep their weapon at home.A crook will think twice about breaking into houses knowing this,people who think the world should get rid of guns should think again.

    This debate is still being framed wrongly. THIS IS NOT ABOUT THE CITIZENS’ 2ND AMENDMENT ‘RIGHT’. It is about the citizens’ Article I Section 8 Clause 15 DUTY to defend the republic by defending our own towns and cities.

    As Stewart well knows (and Oath Keepers has featured), Edwin Vieira Jr is possibly the most important ‘Re-Founding Father’ in this republic. His exhaustive, comprehensive 1700-page work regarding constitutional money of the United States — and now his 2300-page CD-ROM book on the Militias of the Several States, are each in their fields the definitive, complete treatments of these two vital subjects to America’s survival. EVERY top law enforcement officer, and EVERY former or present trained military officer should own these resources. They are vital!

    This is America, for God’s sake. Most military employees don’t understand the U.S. Constitution in context of the framers’ intentions; a government standing army was the LAST thing they’d ever have supported.

    The republic is threatened, as stated above. It’s time to move into civilian training, veteran. There is a paintball facility in almost every community; if not, you can open one. There are hundreds and even thousands of citizens in most American metro areas — and at least many dozens even in small towns — who will pay to be adequately trained for emergency muster and tactical defense, as is stipulated in Article I, Section 8, Clause 15.

    To enforce the laws of the Union (the Constitution foremost!), suppress insurrections, and repel invasions is NOT the duty (or legal authority) of the local police, and certainly not of the U.S. military. It is the duty of the officer force authorized by the State Legislature (read Clause 16), and can of course include armed and trained personnel from State, County, or City employee rolls. But the main force — the “troops” on the ground in these United States have always supposed to be, and must always be, CITIZEN MILITIA.

    Millions of citizens are buying revolvers, pistols, and long guns of every type — with not the slightest idea of their safe handling, maintenance, and tactical use. I believe a majority of these citizens will jump at the chance, for a reasonable fee, to receive serious Militia training to meet their DUTY stipulated in Clause 15. What about it, folks?

    Just as critically, the legislatures of every State must be briefed, and a champion for the Clause 16 duty of the states, must be recruited in each of the 50 legislatures. Their briefing should come from those who know their subject…and who have studied Dr. Vieira’s CD-ROM resource:
