Seattle Mayor Mike McGinn says he’s making an emergency declaration allowing police to confiscate items that can be used as weapons following violent May Day protests that left storefronts and car windows shattered.

Police said officers made at least three arrests after hundreds of people marched through downtown Tuesday afternoon. A 23-year-old man was arrested for vandalism and a 19-year-old man with a knife was also arrested.

Protestors dressed in black clothing smashed windows of retail stores and banks, and spray-painted parked cars, reported Q13 FOX News. NikeTown, American Apparel, HSBC, and Wells Fargo were among the businesses protesters vandalized.

McGinn said protesters were using items that looked like flagpoles as weapons. He said his order would enable police to take those items away from people before they are used to cause damage. McGinn said his action would help protect public safety as protests continued into Tuesday evening.

That confiscation order, authorizing disarming EVERYONE in an area, whether breaking the law or not (whether violent or not, destroying property or not) is similar to Katrina, and is likewise unconstitutional. Peaceable citizens should not be disarmed because others MIGHT be violent, or MIGHT destroy property. Just as citizens should not be silenced because others MIGHT use free speech to incite violence. Both are prior restraint of a constitutional right, and both are overbroad, sweeping in constitutionally protected activity.

We must stand for the Second Amendment as much as the First.

Site Dedication

This site is dedicated to the memory of John William Adams (1925-2006), Marine and Oath Keeper extraordinaire.

John Adams, at the age of 16, lied about his age to join the Marines so he could fight against Imperial Japan in the Pacific. His enlistment date was December 10, 1941, just three days after the attack on Pearl Harbor (see below). As a Marine rifleman, he fought the Japanese from island to island, across the pacific, including at Iwo Jima. We may have good men, but we never had better.

Until his death in 2006, he was a dedicated patriot who still took his oath to defend the Republic deadly serious. May God grant you the courage to do likewise.

Stewart previously wrote the monthly Enemy at the Gates column for S.W.A.T. Magazine

Stewart graduated from Yale Law School in 2004, where his paper “Solving the Puzzle of Enemy Combatant Status” won Yale’s Miller prize for best paper on the Bill of Rights. He assisted teaching U.S. military history at Yale, was a Yale Research Scholar, and is writing a book on the dangers of applying the laws of war to the American people.
