Defense Secretary Leon Panetta’s testimony asserting that the United Nations and NATO have supreme authority over the actions of the United States military, words which effectively declare Congress a ceremonial relic, have prompted Congressman Walter Jones to introduce a resolution that re-affirms such behavior as an “impeachable high crime and misdemeanor” under the Constitution.

During a Senate Armed Services Committee hearing yesterday, Panetta and Joint Chiefs of Staff Chairman Gen. Martin Dempsey brazenly admitted that their authority comes not from the U.S. Constitution, but that the United States is subservient to and takes its marching orders from the United Nations and NATO, international bodies over which the American people have no democratic influence.

Panetta was asked by Senator Jeff Sessions, “We spend our time worrying about the U.N., the Arab League, NATO and too little time, in my opinion, worrying about the elected representatives of the United States. As you go forward, will you consult with the United States Congress?”

The Defense Secretary responded “You know, our goal would be to seek international permission. And we would come to the Congress and inform you and determine how best to approach this, whether or not we would want to get permission from the Congress.”

Despite Sessions’ repeated efforts to get Panetta to acknowledge that the United States Congress is supreme to the likes of NATO and the UN, Panetta exalted the power of international bodies over the US legislative branch.

“I’m really baffled by the idea that somehow an international assembly provides a legal basis for the United States military to be deployed in combat,” Sessions said. “I don’t believe it’s close to being correct. They provide no legal authority. The only legal authority that’s required to deploy the United States military is of the Congress and the president and the law and the Constitution.”

In an effort to re-affirm the fact that “the use of offensive military force by a President without prior and clear authorization of an Act of Congress constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution,” Republican Congressman Walter Jones has introduced a resolution in the House of Representatives.

The full text reads;

Expressing the sense of Congress that the use of offensive military force by a President without prior and clear authorization of an Act of Congress constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.

Whereas the cornerstone of the Republic is honoring Congress’s exclusive power to declare war under article I, section 8, clause 11 of the Constitution: Now, therefore, be it

Resolved by the House of Representatives (the Senate concurring), That it is the sense of Congress that, except in response to an actual or imminent attack against the territory of the United States, the use of offensive military force by a President without prior and clear authorization of an Act of Congress violates Congress’s exclusive power to declare war under article I, section 8, clause 11 of the Constitution and therefore constitutes an impeachable high crime and misdemeanor under article II, section 4 of the Constitution.

Under the terms of Jones’ resolution, both Panetta and Obama would be subject to impeachment for abusing their power and violating the Constitution in disregarding the authority of Congress and placing a foreign power above its jurisdiction.

Despite the Pentagon’s efforts to claim that Panetta’s words were misinterpreted, the Obama administration itself has routinely cited the authority of the United Nations in relation to last year’s invasion of Libya, which was conducted without approval from Congress.

In June last year, President Obama arrogantly expressed his hostility to the rule of law when he dismissed the need to get congressional authorization to commit the United States to a military intervention in Libya, churlishly dismissing criticism and remarking, “I don’t even have to get to the Constitutional question.”

Obama tried to legitimize his failure to obtain Congressional approval for military involvement by sending a letter to Speaker of the House John Boehner in which he said the military assault was “authorized by the United Nations (U.N.) Security Council.”

In boldly asserting the authority of international powers over and above the legislative branch, Panetta and Obama are openly declaring that they no longer represent the American people and instead are water carriers for a global dictatorship that has usurped the sovereignty of the United States.

    We do not take our orders from foreign powers, plain and simple. They say that he used the wrong word “permission”, I say Freud’s theories are sometimes correct. I cannot say certain things as an active duty member of the armed forces, but I can say that what he said did not follow along with the constitution and that it is becoming more and more frieghtening everyday to see the governement attempting to claim more and more power. Currently the people are to blame however, they have become so affraid as to become weak in their voice, people need to quit being affraid of what could happen and they need to watch what is happening. Educate your neighbors, family, and everyone that you come across, that is what will change things for the better, education of the people, help them get off their knees as slaves to fear and political rethoric, and stand free people.

    Can someone PLEASE tell me why the oath keepers in the military are not standing on the doorsteps of the capitol and saying NO??? I wrote to our local state militia and asked the same question, where are they, I got no response, is all of their rhetoric folly and window dressing on the web for ego’s sake or will someone actually stand up and throw the bums out? We have just been told that “We the People” no longer have the right to protest our government when it is doing wrong? “Congress shall make no law restricting…” The indifference and general lack of anything that even resembles a true patriot saddens me, why are you all allowing this to go on day after day? I am just a working man, one man, not in uniform yet I DO stand by our constitution and Declaration of Independence. PLEASE men in uniform stand with me and take a real stand by marching on Washington and demanding the resignation of everyone who signed these unconstitutional bills into law? Where did our country go? I know this is not what my father fought for as a vet. Posting on the internet is not enough. STAND UP AMERICA before they take every right our fathers fought for away from us.

    Marshall Law and the implimentation of NDAA, ACT, SOPA, PIPA, TSA, Patriot Act, & who know what other “ACTS” this GOVERNMENT has initiated has annhilated our CONSTITUTION. IMPEACHMENT is too good for these ‘goons’! Line them all up against the wall!!
    “Keep Your Shot Bag Full, Your Powder Dry & A Biscuit In Your Pocket”. The 2nd Amendment has been sent down the road with the Constitution & The Bill Of Rights! “IF” we have another presidential election, it will be our ‘last’!

    Churchill, what we need to do is demand that Obama, Panneta, and Gen Dempsey be impeached (where applicable), then also prosecuted for their crimes both civil and criminal. then we need to go after every single domestic enemy within the three branches of our government and arrest, hold them for prosecution. It is past time that we start going after (legally, under our Constitution, not using the stuff domestic enemies put in it to weaken or destroy it. Somewhere there is a passage which says that the time doesn’t not matter, but if it is illegal under our Constitution, no matter when it is done, it is still illegal).

    The other thing that we need to do is to realize that not keeping the Oath is a crime, civil, and also makes them NO LONGER ELIGIBLE for the position or office they are currently occupying.
    The first law statute of the United States of America, enacted in the first session of the First Congress on 1 June 1789, was Statute 1, Chapter 1: an act to regulate the time and manner of administering certain oaths, which established the oath required by civil and military officials to support the Constitution.
    This sets that constitutional regulations as to the time and manner the Oaths are taken. This makes it illegal to break them and there are legal precedents.
    The wording of the Presidential Oath was established in the Constitution in Article II, Section 1, Clause 10. The requirement for all Federal and State Civil officers to give their solemn and binding Oath is established in Article VI, Section 1, Clause 4. They are BOUND by their Oath to support the Constitution, and should they abrogate their Oath by their acts or inaction, are subject to charges of impeachment and censure. Breaking the oath was used in legal proceedings, not just as a political offense, but a civil one also.

    “Perjury” – “violation of an oath”, “lying under oath about a material matter”
    “Bound” – “Being under legal or moral obligation; To constitute the boundary or limit of; To set a limit to; confine”
    Solemn: “marked by the observance of established form or ceremony”, “legally binding, Common legal phrase indicating that an agreement has been consciously made, and certain actions are now either required or prohibited”, “The other requirement for an agreement or contract to be considered legally binding is consideration – both parties must knowingly understand what they are agreeing to”. (ex: America fully expected a president who followed the US Constitutional definition of how our government operates. Part of his “why he was better candidate” brought up many times while running was that he was a “Constitutional Professor”)

    (The framers wrote the United States Constitution, which delineated a constitutional federal republic. It would consist of three separate but equal branches which were not only designed to perform separate and distinct duties, but to keep each other in check, preventing one from gaining arbitrary power. All of these branches were to be checked by the standard of law set forth in the Constitution, which each officer of the government must swear to uphold. If those officers should fail to keep their oath of office, then it is not only the right but also the duty of those who chose those officers to remove them. The success of this form of government depends heavily upon the vigilant and attentive execution of these duties.)

    That the laws they make are NOT Constitutional which makes them illegal here. Yes, I realize that they have been enforced anyway, but they were also enforced in Germany, and did not make those any more legal – just took longer to finally catch them and bring them to trial. The actions they have been doing are actions of a domestic enemy, criminal working against our country from within, which is what a traitor or domestic enemy does.

    It is up to us as to how much more damage we let them do to our nation. Arrest, hold, Prosecute the domestic enemies within the three branches of our government and our military (starting with gen Dempsey)

    I also am frustrated. But I do understand that the military and law enforcement who are NOT working against our nation do realize that the domestic enemies will use those who will allow them to be used against us.

    Some things that most should understand: Patriot Act extension and additions to, NDAA, etc, the freely admitted working for the UN and NATO and NOT representing the USA means they feel they are ready and have troops in place and feel we can actually do nothing.
    If I had legal authority under our US Constitution and the “legal” laws we have, I would go start arrests. Why? Because I believe that even though that would most likely cost me and any who went with me a “high price”, I believe waiting much longer will cause many more to pay a much higher price. This is my personal opinion.
