Judge tells Tennessee to stop arresting Occupy protesters

(CNN) — A judge told Tennessee officials on Monday to stop enforcing new rules that have been used to arrest Occupy protesters in Nashville.

The decision was a victory for the fledgling movement and for the American Civil Liberties Union of Tennessee, which sought a temporary restraining order to block a curfew put in place last week.

U.S. District Judge Aleta Trauger issued the order, which state officials did not fight.

“Political expression deserves the highest level of protection and it was unacceptable for the state to suddenly shut down protesters’ speech and forcibly oust them from Legislative Plaza that has long been used as a place for peaceful expression,” said Hedy Weinberg, executive director at the ACLU of Tennessee.

“The state conceded that the temporary restraining order should be issued and we hope that this is the first step (that) the state is recommitting itself to safeguarding — not thwarting — public political expression,” she added.

Efforts by CNN to reach officials in the state attorney general’s office were not successful.

The order will remain in effect for 21 days. A hearing in the case is scheduled for November 21.

Demonstrators across the country are protesting what they consider to be corporate greed and corruption as part of the weeks-long “Occupy” movement. Many say the nation’s wealthiest 1% hold inordinate sway over the remaining 99% of the population.

In Tennessee, protesters have gathered at Legislative Plaza in downtown Nashville since early October.

Authorities issued the new rules on Thursday, requiring protesters to have permits and restricting the times they would be allowed to gather.

In subsequent days, protesters were arrested, including more than two dozen overnight Saturday, after they defied the curfew imposed by the state’s governor. Most received citations for trespassing, while two others were cited for public intoxication.

    OAKLAND, Calif. • Oakland police handed out eviction notices at an anti-Wall Street encampment and officials elsewhere urged an end to similar gatherings as pressures against Occupy protest sites mounted in the wake of three deaths in different cities, including two by gunfire.

    Police first pleaded with and then ordered Occupy Oakland protesters to leave their encampment at the City Hall plaza where a man was shot and killed Thursday.

    Officers acting at the direction of Mayor Jean Quan distributed fliers to protesters late Friday afternoon warning that the camp violates the law and must be disbanded immediately. The notices warned campers they would face arrest if tents and other materials were not removed, although the warnings did not say by when.

    The city issued similar written warnings before officers raided the encampment before dawn on Oct. 25 with tear gas and bean bags projectiles before arresting 85 people. A day later, Quan allowed protesters to reclaim the disbanded site and the camp has grown substantially since then.

    Earlier, the Oakland Police Officer’s Association issued an open letter saying the camp is pulling officers away from crime-plagued neighborhoods.

    “With last night’s homicide, in broad daylight, in the middle of rush hour, Frank Ogawa Plaza is no longer safe,” the letter said. “Please leave peacefully, with your heads held high, so we can get police officers back to work fighting crime in Oakland neighborhoods.”

    the post above is very misleading as it leaves out these words from terry collins: “Police officials have said a preliminary investigation suggested the shooting resulted from a fight between two groups of men at or near the encampment. Investigators do not know if the men in the fight were associated with Occupy Oakland, but protesters said there was no connection between the shooting and the camp.”

    a few comments from #Occupy patriots:

    “I’m sure that there are the old “union busting” techniques being used here as well. Come on…for the first few weeks nothing …then when they’re getting noticed all this stuff is happening …I don’t believe in coincidences.”

    “Before I got detached to report on Occupy Oakland, I spent most of my time with people who live in a world where shootings like the one that occurred last week are, sadly, part of everyday life. This hasn’t changed in the last four weeks, unfortunately. Many of the daytime and weekend occupiers, though obviously not all, are solidly middle class, live in safe neighborhoods in Oakland or Berkeley or elsewhere, and come downtown to express their views among a group of like-minded people.”

    “Reimann said he felt safer in the camp than in his own neighborhood, where, he added, he would never walk around at night. “I walk around at night all the time here.”

    Misleading??? I posted the link to the entire story, or did you miss that? These Oxygen Thieves do not have some noble cause for a greater America, rapes, robberies, disease and violence in their ranks, and you’re defending them, why? Oh yeah, it’s their 1st Amendment right, whatever,…Tea Party folks have got it right, not these losers….

    I’ll just point out that the First Amendment is for all Americans. All Americans, all the time.

    I join Sheriff Mack, Board member at Oath Keepers, in working with the Tea Party movement in America. And I think it is shallow to try to use the refuse which sometimes come to the OWS rallies to denegrate or disrupt the peaceful protests. We’ve had similar situations here at Oath Keepers, in which cases complete idiots come in here spouting their inane extremism – and the SPLC and ADL have enjoyed making a case against Oath Keepers simply because such idiots are attracted to our organization. Oath Keepers is not affected by the idiots, but the perception that ADL and SPLC (and soon to come, the DHS as well) put out to the nation is that Oath Keepers is an organization packed with idiots running around with hair-triggers.

    This is the same thing that is happening to the bulk of the protesters at OWS rallies. And some people, even some here in Oath Keepers, are falling for it. People, it’s a trick, a mind-game. Do not be deceived. Yes, there are extremists at the peripheries of any and all good organizations or political movements. Please don’t let the fringe color the truer picture represented by the vast majority of those involved. Let’s try to grow up and realize that some people in places of power are using the media to spark divisiveness. (I already know that many reading here will not take my advice on that, but I’m saying it anyway.)

    Experience shows that when one is quick to judge one opens the door to later be proven wrong.

    But no matter how anyone reading here wants to perceive the propaganda surrounding OWS, I am saying loudly and proudly that the First Amendment is here for all Americans, all the time. Deal with it.

But OWS is largely a criminal element – not some fringe elements causing trouble, not a movement with clear, lawful goals and objectives and executing that right within lawful protest. It’s a moving encampment of the dregs of our society that somehow got the idea that the government owes them something. That’s Socialism, and not what this country is built on. I’ll defend anyone’s right to have a voice, but let’s get real with who we’re talking about here, Flea Party over 700 arrests. TEA Party – 0.

    blood1488honor, the hard truth is not hard at all unless one is opposing the truth. The truth is that the First Amendment is for all Americans. The only time that truth becomes hard to accept is when one pre-judges one’s good neighbor American citizens and can say -

    “I agree completely that the First Amendment and all the others are for all Americans – But…”

    There is no “But”. When we succumb to the temptation to ostracize anyone, we ostracize ourselves, and that is a point I’d like to drive home for our readers. There can be no “But”.

    Please understand. There are bad people, evil people, people who would control other people, people who are a disgrace to all people. Plenty of that sort exist yet today right here in America. But they do not represent Oath Keepers or our ideals, do they? No, they do not. But if someone sitting over there in Europe sees an idiot attaching himself to Oath Keepers, that European citizen would be making a mistake to classify all Oath Keepers based on what the one idiot is saying.

    It’s the same way with the Occupy movement. I know as well as you do who is behind the start-up of OWS, but even the local organizers are unaware (for the most part) of the greater and hidden powers which planted the seeds originally to get the movement going. To make an effect, the Soros bunch has sent in the unions, the socialists and communists, the repulsive extreme agitators – but those idiots are not, I repeat, *not* connected with the greater truth which has drawn so many young Americans to the protests. Wall Street is as corrupt as Lucifer himself, through and through, and if anyone wants to debate me on that statement I’m ready to defend my view.

    The system is broken, is in the process right now of collapsing, and the collapse is being facilitated by the Federal Reserve and its flunky greed-masters on Wall Street, who are covered properly in James Jaegers movie, Corporate Fascism.

    What Soros wants you to believe is that the monopoly capitalists on Wall Street are the good guys and his communist slimy green-toothed protesters at OWS are sent out there on the street to repulse you and me and the middle class of America. Soros wants to do this so his criminal bankers on Wall Street can continue to bilk the American tax payer and collapse our great nation from within, using the Fed’s monetary practices to seal the deal.

    We have to keep our eye on the target at all times. You and I need to defend everyone’s right to redress grievances, to publicly assemble peacefully, to speak our minds and our hearts, and even to cry out against the tyranny which is being pushed down our throats by this massive and globally-organized socialist threat which combines monopoly-capitalism with cultural Marxism. So Soros and his minions have blurred the truth between what a monopoly-capitalistic system is and what a free-market true capitalist system is. Note that we have not had true capitalism in America for a very long time, over a Century in fact.

    What better method can the elite who are destroying our country employ than to divide the people into two camps, the Tea Party anti-criminal-government movement and the ‘liberal’ anti-establishment movement? We are in a war for our very minds, and our perceptions are being manipulated by the media, the bankers on Wall Street, and our own Federal government, which is in bed with the Federal Reserve and which works for the power elite who want a one-world government. They have to collapse the American middle class to get what they want, and they’re using your repulsiveness toward the OWS movement to a tee.

    Patriots are going to have to elevate their awareness levels, their mental perception powers, above this false “left-right paradigm” to see clearly. For those who are victimized by public relations from Wall Street and the Federal government, and who are having trouble seeing through the smoke-screen of shrieks and yells that the OWS movement is “communist”, all I can say is that our solution is the Constitution and our adherence to its provisions of liberty for all Americans.

    We’re being attacked by a psy-op, Bro. We must question our very own perception of reality, and we certainly need to cease-fire on those other Americans with whom we associate “the enemy”. Failure to do that will perpetuate this insane divisiveness which is keeping the people from exercising their true power over their representative government.

    Wish I had time to lay this out for you more clearly, but I don’t, so please just remember that for any and every Amendment in our Bill of Rights (the first ten Amendments), there can be no “But”.

    Thank you Brother. You’re just where you think you are, and rightly so, but as you can see there is great confusion among the American people right now. Their awakening is somewhat abrupt and disquieting, and there is much to be shared with each American who is trying to suddenly sort out what is happening to our country. Oath Keepers is grateful for your support.

    The overwhelming majority of our membership knows to keep our eyes on the Constitution above all else, and I’m sure they, as do I myself, appreciate your comment here. Thank you for fighting with Oath Keepers for this Republic. As you can see, the battle for the perception of the American people is in full warfare stage as we speak, so we need calm rational awake people like you to help us hold the rudder true to course for the Constitution. Keep the faith, Bro!

    I pretty much agreed with Karl over at the Market Ticker when OWS first started. And to some small degree, I still agree with those within who are still sane enough for ending the Fed, bail outs and such. But I think those people are fast being pushed aside. After spending much time on Twitter watching the various OWS/Occupy, I started watching the independent peoples Twitters aligning/piggy-backing on OWS/Occupy. Well, lo and behold, wouldn’t you know that there are some pretty foul groups of people aligning with OWS/Occupy.

    Anyhow, Karl gives us this:

    Well, I doubt Karl reads my blog, but I have news for him about “dirty tricks”. I have spent a lot of time on Twitter with these people espousing the idea’s of liberty, telling them that they need to police themselves, not to let the socialist and communist ideologies saturate the movement, linking them to various articles throughout the web and such. Some of the groups were supportive in that end.

    But surprisingly, groups like OccupyArmy, OccupyMarines, OccupyNavy, OccupySEALs who have taken it upon themselves to be the “protecters” of the protesters, aligned with hacker groups, are taking it upon themselves to do what they call “d0xed”. Basically, they are busy trying to find out information on people with whom they disagree with such as names, pictures, addresses, phone numbers and such and post this information online.

    So, I have news for Karl. He is out of line bitching about “dirty tricks” in his above post and has his head up his butt on this one. I’m just a liberty activist and these ***** think they are going to out me and intimidate me into keeping my mouth shut? Because I am espousing liberty? Return to a constitutional republic? Binding the government with the chains of the constitution? Telling them that they need to separate themselves from the socialists. communists and such?

    As for OccupyArmy, OccupyMarines, OccupyNavy, OccupySEALs and your hacker friends. Since I know you have been peeking around my blog … you people don’t give a flying **** about liberty and restoring our constitutional republic. Assuming you close down the Feds, eliminate the unjust bailouts to the Banks and Wall Street, etc., what are you going to replace the rest of it with? Socialism? Communism? Fascism? Stupidism? Yogaism? Go ahead and give it your best shot. Like I said, I have cookies and milk waiting for you. If you are man enough to look me in the eye… Well, when you think you got me … come and get me.

    Frankly, the longer OWS/Occupy goes on, the bigger the socialism/communism/stupidism/yogaism grows, and those who espouse liberty and the return of our constitutional republic shrinks. And personally, for those who call themselves Army/Navy/Marines/SEALs Occupy, I have to doubt your sincerity for liberty. In fact, I doubt your service.     All right. That’s fine. If you want to understand OWS/Occupy/Anonymous/usrevolution and the hundreds of other groups that have sprung up, then open up a Twitter account and spend about 4 weeks at 2-4 hours a night like I have, and you’ll start to understand what OWS has become. You also want to learn how to read their followers on Twitter and read them.

    Bluntly, the more time I spent there, the more downhill it went as far as my hope for OWS. While there are still some good people there, they have by far become the minority. When this thing is over, I can see that the means will not justify the end.

    If you think these people have any inkling of restoring our constitutional republic… well, when they are done… see you all on the other side.
