Army Vet and His Story


ArmyLogoI served honorably in the Army in Korea and in Vietnam during the wars there.  My primary duty in the 21 years I spent in the Army was that of a CID agent, i.e., a criminal investigator.  One one occasion I was ordered by a senior officer to discontinue a major investigation.  This being an illegal order, I continued the investigation – the result being that the senior officer and a number of accomplices went to prison.  My retirement from the Army was under honorable, even meritorious conditions.

After my retirement from the Army, I joined a federal law enforcement agency where I served in a senior position and retired under honorable conditions with a number of awards for meritorious service.

Military law is explicit:  one is not required to obey an illegal order and may be disciplined for doing so, depending on the results.

It is my impression, also, that police are not required to obey an unlawful order and may be subject to disciplinary action if they do so, but must be prepared to defend their actions in refusing the order before a civil service or other investigative board.

My oath to defend the Constitution against all enemies, public and private was made many years ago, but it is still binding and I will do so whenever it is necessary.

In my opinion, and in the opinion of authorities such as Senator Byrd, the present administration has, on a number of occasions, violated the Constitution.  It appears intent on continuing this course of behavior with the unfortunate complicity of many of the members of Congress.

I appreciate this opportunity to re-state the oath I made many years ago and encourage everyone to protect and defend the Constitution.

    I hope your still around to read this. Got a question for you sir, ref the Ft Hood Shooting incident, and the first responders.

    Upon first hearing about this incident, one thing that came out was that the Uniform police officers who responded, and took the Maj down, at first, the reports made it appear that these officer’s were of Killeen PD because clearly, the report indicated that the officers were NOT MP’s.

    In my day, if i needed law enforcement intervention, and i called for that, on any post, i got MP’s who operated under authority of the POST PROVOST MARSHAL. Is the use of civillian polace agencies now used wide spread on all army reservations. or just a practice at FT HOOD? Do they answer to the PROVOST MARSHAL? Where does the traditional MP’s fit in to this situation? The chain of command & authority? Who holds ultimate authority at FT HOOD? Or any millitary reservation? A civillian police agency, or the MP’s. Lastly, why the hell would we need any civillian uniform police operation on ANY mill reservation When we got the PROVOST MARSHAL, THE mp’S, AND YOUR FORMER INVESTIGATIVE DIVISION (CID)

    Incidently, i passed through FT HOOD back in summer 2000 and i didn’t see any civillian police agencies operating there then.

    As an ex Marine Military Policeman (5811) and have being to five Countries the only Civilian Police were at overseas bases. They were there for the translation of their language and that was all! But back in the States I have never seen Civilian Police on base. It was Military Police in everything on base! Sounds like we are getting too relaxed on the Security of bases. There is no need for Civilian Police on Base. And before they could come on base they had to asked the Provost Marshalls permission! But then again that was in the seventies!

    The officers at Ft. Hood are Department of the Army Civilian Federal Police Officers. They have the exact same jurisdiction and authority as the MP’s and act under the authority of the Installation Commander. MP’s are still there but the majority of the patrol operations are handled by DA civilians, and yes they do answer to the Provost Marshall. They are either certified officers when they are hired or they are sent for training and certified by the Military Police School at Ft. Leonard Wood.
