The below video was taken on Tuesday, August 25th, 2009 at Rep. Jim Moran’s (D-VA) Town Hall meeting on Obama Deathcare (Howie Dean was there too) held at South Lakes High School in Reston, Virginia, in Fairfax County.
Many people were left outside when the school filled to capacity. Fairfax County School Police Officer Wesley Cheeks, Jr. did not approve of a protester’s anti-Obamacare poster (shown above) which used one of the “Joker” graphics.

Good example of content based discrimination. Yes, the public school used for a public town hall may be a limited public forum, under First Amendment case law, and there may be regulation of the general use of signs (maybe) during the event, but any such regulation of how someone expresses their speech must be applied equally to all, and when you target a particular sign for its content, while letting others alone who also have signs, that is discrimination against that speech (the sign) based on its content, rather than simply prohibiting all signs. That is known as “content based discrimination” in legaleese, and it is unconstitutional.
It looks pretty obvious that this officer just didn’t like the message of the sign and was targeting the content of this protesters speech.

Let them know that, contrary to what their officer thinks, this is STILL America, the Constitution has not yet been scrapped, the First Amendment still applies, and their oath requires that they respect the right to free speech of all Americans, even when the officer does not like the speech. The First Amendment does not just protect speech the officer on the scene agrees with, and he is not free to implement his own mini-constitutional suspension zone.
Be polite, but firm. Don’t use profanity, but let them know that as an Oath Keeper, you don’t appreciate the oath breaker they have on staff.

As a law enforcement official, I would like to say that not only is Officer Cheeks an ignorant unprofessional idiot, he will most likely be a captain, or a commander, in Obama’s Nation Security Force.
I too am a police officer and this makes me ashamed. We are supposed to defend the rights of the citizens we are sworn to protect. This is something I have noticed, many of my fellow officers may not in the end hold up their end of the oath.
Unacceptable. He has no business in law enforcement.
God help us if our police officers and Military take this attatude.
I just called and left a mssg for the head of internal affairs, calling his attention to this Video, telling him cheeks should be fired. If enough of us apply pressure, at the very least someone should discipline him. This is outrageous. I would have demanded Cheeks try to arrest me and if he had, I would have sued for false arrest, and if he touched me, if he put cuffs on me, I’d sue him for Battery as well.
As a federal law enforcement officer, I can say that Officer Cheeks is a disgrace to our profession. There might even be a case made here that Officer Cheeks committed a felony crime under 18 U.S.C. § 242, where he, under the color of law, willfully deprived a person of a right protected by the Constitution of the United States.
For the purpose of Section 242, acts under “color of law” include acts not only done by federal, state, or local officials within the their lawful authority, but also acts done beyond the bounds of that official’s lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties.
Persons acting under color of law within the meaning of this statute include police officers and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is NOT necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.
The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

The more I look, the more I see civil unrest here within the United States of America.. I’m shocked at the intensity of the protest against this health reform, while at the same time, I am just as shocked to see the intensity for with it is trying to be past.
I have seen more and more Police harassment, which borders on Police brutality, while at the same time, I have seen a true hatred (with a passion) towards Law Enforcement Officers..
I have seen down right greed being committed by US Corporations, our banking institutions and oil companies are literally raping us at will… AND.. no one (with the power to stop them) really seems to care.. All the while, people are losing their jobs, having their houses, cars and other property repossessed..
The only thing I dont see is a solution to this mess… We are on the downward spiral my friends and if someone could tell me how to make it stop and allow me to get, I sure would appreciate it..
I have seen many of these type of confrontations at town hall meetings. There seems to be one common denominator. The police officers present appear to be either intimidated by the crowd or are being given orders to remove anyone that is not there to agree and play nice with their elected representatives.
I’ve also seen the police allow the SEIU and ACORN thugs’ man handle the protesters. Some of which were senior citizens or disabled veterans.
This is not about health care reform. This is about the progressive liberal wing of the Democratic Party using strong arm tactics against their constituents and the moderates within their own party. To Further their agenda and strip this republic of the very fabric of which it was formed.
We must go beyond TEA parties and lawfully assemble to let the politicians know loud and clear and without a doubt that this is a true grass roots movement. We didn’t invent Astroturf.
If I’m not mistaken Mr. Obama’s senior advisor David Axelrod is a real pro at forming these fictions groups that are designed for intimidating we the concerned citizen.
Now is the time to act.

I am also a cop and have been one for 33 plus years. I’m glad to see other law enforcement officials that are outraged by this. Let me state that in NO WAY does this represent the 99% of us out there that would never have handled this situation in this manner. I would also state that citizens that are concerned, and rightly so after seeing this abomination, that law enforcement would somehow succumb or capitulate to being reduced to government “thugs” that take away citizen rights… it ain’t gonna happen. There’s too many of us out there, black, white, brown, red, yellow, male and female that are too professional, too intelligent, too honest, too dedicated to doing the right thing to ever let that happen. I can see how you have come to that conclusion based upon at least two videos of black officers acting as enforcers for black or union groups but sir, let me state that we in law enforcement are even more appalled than you are and will never be reduced to that. This may very well be a “weeding out” period for our profession, and we are with you all the way. Most of us understand what is going on, most of us don’t want to see law abiding citizens lose their rights to carry firearms, we are comforted by them having our backs if necessary. So what happened to the protester? Was he arrested? It isn’t clear from the posting. From what I can see, the cop walked away. If he wasn’t arrested then how were his rights denied? Maybe the cop was having a bad day. Fine him a couple of days’ pay and make him go to sensitivity training. To read into this that there is a major conspiracy going on is really a stretch. Just be glad he’s not asking for a hunting license to hunt for protesters.

I just left a nice, lengthy message to their internal affairs department. Follows:

Maj. Morris, a recent video has surfaced of a town hall demonstrator trying to post a poster during a meeting on school property. I understand that schools have different rules and regulations regarding the posting of material, however, the school was being used as a public meeting ground and other material had been posted without incident prior to this particular incident. Officer Wesley Cheeks is clearly discriminating against this poster for it’s content although the content does NOT violate ANY laws. This seems to be either a personal bias or an unlawful order to remove/prevent the content from being shown at a public assembly. I am sure Officer Cheeks is a good officer, but I am concerned with this particular incident and the comments made by Officer Cheeks. I am certain that you are aware of the video I am referencing by now and have viewed the content. Officer Cheeks’ remarks to the demonstrator are completely out of line and should be addressed. For one, Officer Cheeks clearly seems to be placing his Oath as an Officer (his “job”) over his Oath to defend the Constitution of the United States. Maybe he just doesn’t understand what that means and needs to be retrained or offered the chance to retake the Oath once he truly understands the meaning. Second, his remarks about “charging” the demonstrator for “whatever [he] wants to charge [him] with” is something that I would personally like to have clarified for my understanding of what Officer Cheeks meant. And finally I would like to know what Officer Cheeks meant by “it ain’t no more” when he was told that this used to be America. Surely he did not mean that we no longer live in America, right? Maybe not to him, but for the vast majority of citizens it IS STILL AMERICA. Perhaps Officer Cheeks could publicly explain his actions and remarks so as not to send the wrong message or idea about Fairfax County Police Department. Thank you for your time.

It would appear that the Oath Keeper site has now made the ACORN target list. With over $1 Billion of your hard earned tax dollars given to ACORN by the Democratic controlled government, they can afford to hire millions of “useful idiots” (Lenin’s words, not mine) to flood websites, message boards, facebook and certain You Tube videos with their profoundly ignorant and hate filled comments. Case in point: The Marine, David Hendrik, who will soon become a member of OK and whose Town Hall YouTube video went viral, (you can see it on this site in the Outreach forum section) has endured his share of ACORN attacks. One of which is posting his address and telephone number, not just on David’s video, but on other YouTube sites as well.
I wrote to David and gave him a heads-up. He wrote back telling me that he was aware of it and contacted YouTube, but so far, YouTube has refused to do anything to stop it. This employee of ACORN is putting both David and his family at risk and yet YouTube is thus far, turning a blind eye to it.
This is the level of malevolence that you will be dealing with if the cockroaches choose to swarm this site.

This is reprehensible behavior by a law enforcement officer. The ACLU should prosecute a case against Wesley Cheeks and the Fairfax COunty Public Schools. The special rules on school property pertain to students during the school day, not when the school property is used as a podium for political speech.
I feel confident that officer Cheeks being a School Security Officer has never had the benefit of a Regional Police Academy. With that being said he more than likely had a few hours of Security training inhouse if that.
I believe the Fairfax City Officers are well trained and would not have handled the situation in a like manner as Officer Cheeks.

I know in Las Vegas, School Police are part of the Metro police department, but probably not in Fairfax, VA. Regardless, I’m sure that the Fairfax police will be having words with the School Security over this based on the amount of outrage I have seen on this. This security officer is probably not an actual police officer and probably never took the oath, more’s the pity. He’s an ignorant dullard and needs to be educated. Here’s hoping this incident will cause our police departments to wake up and see what is happening in our country.

Sorry officer Dave but I grow sick of hearing how it’s only a few bad apples, 99% of cops are good,etc…it just isn’t so. So, if the 85% of us that have employee sponsored health ins. never have to pay premiums (or at least very little in comparison to what the employer pays) and we never have to pay for the actual services we receive, well, then, duh, maybe we as consumers have no reason to be responsible in our consumption of health care. I am not pointing fingers, just stating what I have concluded based on my new knowledge of the Employee Benefits business coupled with my experience of having almost all medical expenses paid in the past. I think the answer is TRANSPARENCY!!!! In every example I can think of with respect to health care, transparency is the answer. Consumers have a right to know what exactly what they are paying for. This does not happen. Also, maybe employees should be made aware of exactly how much money their employer spends on their benefits. Which leads to a second answer: it may be prudent to tax employees on the benefits they receive, that’s it. This money would then go to subsidize hospitals or clinics who provide free care. But, TRANSPARENCY is required on all fronts. The Employers do not need any more taxes than they already have. But, employees/consumers need to become more aware of the amount of money that goes into their healthcare.

As much as I hate to say it, the officer was right. The school board has certain rules and regulations that apply anytime you enter the property. You cannot have a sign or wear clothing that could be considered offensive or disruptive in any way. I personally am aware of many constitution free zones. I have my concealed weapon everywhere I can possibly go with it without getting caught (metal detectors at the court house and airport). In some internet sites people talk about not wanting to be a second amendment court test case. That just tells me they dont really believe. I could go on and on but I’m wasting my breath. I already know how it ends and it aint gonna be pretty.
As far writting the school, the police or my mama for that matter I copied these couple of lines from the school regulations and procedures site.

I have a question. Who gave these officers the power and authority to tell you what you are to do? The answer is simple my friends, YOU, We the people. How do things get turned around to where the officer got power and you dont. Have you ever heard the saying freedom isnt free? What about the Town meetings. People being escorted out while like minded people sit and watch. You wont see me at these meetings. You all are contacting the wrong person. The top official responsible for enforcing the law in Fairfax County is the Sheriff. And for Mr. Morales, regardless of what you might think, there is no such thing as a “Constitution free” zone. If challenged in court, any subsequent law does not and may not supercede the Constitution. Additionally, this officer does not have the authority to determine that one sign is more offensive than another.

While you are correct that some school zone do have rule and regulation that do apply to members of the public that enter upon school grounds DURING SCHOOL hours. The courts have long held that non school related events are not subject to or required to follow special rule and procedure defined by school officals. The same holds true for things like drug free zones, which only apply when school is in session. There are numerous drug conventions which have had “Schoool Zone” extenuating time thrown out, because the arrest occured after school hours. If school property is used for public political events, things such as school dress codes, and political statement bans do not and can not apply. The School Officer should have been told he was there just to protect school property and not to enforce school policies. If it had been me with the sign I would have continued to hold it up. I would recommend the gentlemen in the video file a suit. Officer Cheeks has volated Title 18 U.S.C. § 242 in that under the color of law he did violate this gentlemans constitutional rights of freedom of speech and expression.

I am a Deputy Sheriff in Michigan and I view the actions of officer Cheeks as reprehensible at best and criminal at worst. If I were a Sheriff Deputy at that event I would have givin Mr. Cheeks an ultimatum….give him back the sign or I am about to make the most controversial arrest of my career.
I see some posters here saying that Cheeks is probably a “good cop” or a “nice guy” and I view him as neither. Is this the guy you want defending your rights? Is this the cop that you will look to when you need him to remember his oath? This man is a drone and needs to be sued along with his department. In New Orleans during and after Hurricane Katrina while people were in need of help, medical care, food, water and evacuation, the New Orleans Police Department carried out a house-to-house and traffic stops taking legally owned guns from people. Later courts declared they acted illegally and to return the confiscated firearms but that was never done. They were only following orders.

Leftist protesters always have a lawyer with them when they protest and expect police to confront them. Its is easy to spot their lawyer, they look like lawyers and stand out.
When planning to protest, march, or appear at a town hall meeting, make sure there are cameras recording every minute. If possible, hire a lawyer or get a volunteer lawyer to be with you. The Police will be on their best behavior if a lawyer is present because they know in a court the police do not stand a chance against a lawyer. Twelve years ago, I raised my hand to God and swore to uphold the Constitution of the United States of America. You can take a man out of the Army, but you can never take the Army out of the man. Loyalty, Duty, Respect, Selfless Service, Honor, Integrity, Personal Courage. Being a law enforcment officer, soldier, or even an officer of the court needs to be about two things. Protecting the constitutional rights of civilians, and L.D.R.S.H.I.P.
However, when it comes to the issues we find ourselves facing as a nation, I find myself standing on a knifes edge. No matter which way you look, to the left or to the right, there is someone waiting to snatch away your personal freedoms to increase thier own wealth and power.
I do not believe in totalitarian socialism, whereby all transactions in our ecomomy are regulated by government agencys. That can only lead to absolute disaster.
I do happen to believe in universal healthcare. If our society is to progress and flourish we must provide all people of all economic situations the abillity to contribute to our society in a positive way.
This means providing healthcare, education (to the ph.d. level), and justice (as outlined by the constitution) as a function of that society. At no cost to the individual. So that more people can end up in a lab working on the next best thing instead of in a prison living on our tax dollars anyway.
But the party that stands for those things also stands for this video. Just as the Republicans would take away the greatest tool of free speech in history (the internet) through backroom international deals (ACTA) so would the Democrates press us against the fulcrum of political correctness in an attempt to silence thier detractors.
Just as Republicans will pass unconstitutional laws that allow for the creation of a fascist police state, so would the Democrates control our economy and our welfare through totalitarian socialism.
The right thinks you should give all of your money to the corporate elite, while making a slaves wage. The left thinks you should give all of your money to the government. Both sides think you should be striped of your first, third, and fourth ammendment rights.
All of them are on the take from corporations with special interests making laws instead of better products (where is your free market now?).
