Active Duty Soldier Speaks Up

I intend on following your organization closely while I am in Afghanistan. I want to see it grow and reflect that our military and law enforcement are heavily made up of patriots, not mercenaries, and who fundamentally understand that what is ours already is not the government’s or anyone else’s to give us.
I am the first generation son of a legal Filipino immigrant who cannot understand what these elites in our 2-party system are doing to our country. I have also been an Infantryman since 2004, trained to be what enforces US foreign policy however we are able to.
I take it personally when I see Americans being mistreated and robbed of their own property rights and responsibilities.

16.Look, folks, I GET the idea that the military should not obey illegal orders. But the military is NOT a co-equal branch of the government. Thus, the military has no business interpreting the meaning of the Constitution or organizing itself to act in a political way. None whatsoever.
The people do not need military “protectors” to step in and save them from themselves. The people can defend the republic without the help of colonels in mirrored sunglasses who decide to make themselves the moral guardians of everybody else.
Movements like this always appear to be “well-meaning.” They always present themselves as the “honorable men” who will step in and rescue the “decadent” and deformed republic from the “dirty politicians.” But doing that is the role of civilians.
Organizing the military to take on the role of “putting things right” is a bad, bad, bad idea. This is the road to fascism.
To anonymous: If a soldier or police officer was to obey an unlawful order, they could and would be held accountable for their actions. It is the duty and responsibility for a soldier or police officer to know the law and uphold and defend the Constitution. It is those who wish to move our country away from the Republic that one should fear, not the military and police. Prey, what do you find to be fascist about the orders or those who would reaffirm their oath? Methinks anonymous does not know how to read a map, nor has the balls to put their real name down.
Anonymous – you sir are wrong. The Vietnam War presented the United States military courts with more cases of the “I was only following orders” defense than any previous conflict. The decisions during these cases reaffirmed that following manifestly illegal orders is not a viable defense from criminal prosecution. In United States v. Keenan, the accused (Keenan) was found guilty of murder after he obeyed in order to shoot and kill an elderly Vietnamese citizen. The Court of Military Appeals held that “the justification for acts done pursuant to orders does not exist if the order was of such a nature that a man of ordinary sense and understanding would know it to be illegal.”
The founders intended that ordinary citizens be able to “interpret” the Constitution as it protected their inalienable rights. As as you can see, Military courts have held men accountable for making the right call when they faced such a decision. The order to disarm law abiding citizens for example, is just as unlawful. The myth that the Constitution must be left to lawyers and courts to interpret is overused and transparent. You are either ignorant sir, or a willing traitor.

We do not need people in the military organizing a Honduran-style coup here in the U.S. The military needs to stay out of politics. Like I said, we do not need military “guardians” stepping in to protect the people from themselves. We can get by without that very nicely, thank you.
Instead of stockpiling ammo and organizing support for a potential coup, why not run for office? Why not set your brain to work coming up with a better plan for health care?
If wanting the military to remain under civilian control makes me a traitor, then that is what I am. But I think George Washington would disagree. He took off his uniform for good when he ran for president. He did that for a very good reason.
You are probably a good American. But you risk becoming what you most despise.
If you really, really want to compare the laws duly passed by our Congress with the illegal decrees issued by Hitler, then I invite you to try making that case to the American people. But do not call yourself a “guardian of the Republic” while organizing to take extra-legal action intended to undermine that republic.
Mr. Annonymous. Which part of the 10 unlawful orders that will not be obeyed mention Honduran or any other style coup? Where does the stockpiling of ammo come in? How about the military \"stepping in\"? All not part of the Oathkeeper creed.
In simple terms, the oathkeepers only reaffirm that they will not violate the laws of the Constitution (which implies not taking \"extra legal\" action in that pursuit.) They will not be tools in the hands of totalitarians.
I agree that fascism and force are not roads to freedom. Neither is Progressivism. Individual Constitutional rights enable the greater good rather than being subject to it. Those that do not defend and support our Constitution are, knowingly or unknowingly, traitors. Socialism itself is unconstitutional. Redistribution of wealth and property is Marxist. No government can truly work for the \"greater good\" if it usurps the people\’s power only to build an elitist oligarchy (using both parties), as is happening now. We too will have our Bastille day, only our guillotine will be the ballot box.
If you really are a patriotic American, read up on progressivism, socialism, marxism, and most importantly, the Constitution (the 5000 year leap is a great primer.) Once that is done, I think you will be on the side of the Constitution, and as good a liberal as Thomas Jefferson, if you can free your mind from the reassuring chains of Progressive masters.

To my knowledge, wars in Afghanistan and Iraq were unconstitutionally started since Congress did not declare them. Doesn\’t this mean you should immediately withdraw from those countries in order to uphold your oath?

I think that is a good question, but as you may have picked up, the 10 orders focus on the domestic, and on specific oppressions of our civilian population that are unconstitutional. I think a deploying troop could take that one to court, but I don’t know the latest read on declared wars myself. Any sage words for that one Stewart?

US Congress passed the Joint Resolution to Authorize the Use of United States Armed Forces Against Iraq on October 11, 2002
The Authorization for Use of Military Force Against Terrorists (Pub.L. 107-40, 115 Stat. 224, enacted September 18, 2001), one of two resolutions commonly known as “AUMF” (the other being “Authorization for Use of Military Force Against Iraq Resolution of 2002″), was a joint resolution passed by the United States Congress on September 18, 2001, authorizing the use of United States Armed Forces against those responsible for the attacks on September 11, 2001. The authorization granted the President the authority to use all “necessary and appropriate force” against those whom he determined “planned, authorized, committed or aided” the September 11th attacks, or who harbored said persons or groups. The AUMF was signed by President George W. Bush on September 18, 2001.
So BOTH wars had congressional approval.

You wear the uniform with pride, that is a good thing; I too wore mine with pride, and beleived, at the time, 67-73, that we reall were doing something that was good(in Viet Nam).
But while you are in Afganistan defending American interests(??) you might ask yourself WHAT those interest REALLY might be; and ask WHY it is that while you and others like you shed your blood for what you beleive is someone’s alleged liberty, how it is that the tax funded CIA, a misnomer in itself, is seeing to it that thousands of pounds of Afghani heroin is being shipped into the nation you’ve been told you’re defending. Air America, the CIA fraudulent front for nothing more than a government style Mafia drug operation, even more insidious than the Mafia, is still alive and well. Being in Viet Nam gave them a lucrative drug source; being in Afghanistan gives them another. Am certainly glad that my tax dolalrs are hard at work fighting the alleged “War On Drugs”.
What liberties, according to the government, would I LOSE here in America if we weren’t in Iraq or Afghanistan?? I’ve been losing them year by year long before anyone even heard of the Taliban or AlQuaeda. I’m a Vietnam era vet with an opinion (whoopee) on the Oath Keepers premise. It’s kinda preachy so bear with me…
Watch yourself guys. You’re putting the good old US of A on the slippery slope that could jump start something like a South American military junta or banana republic military dictatorship. Just look at the tea baggers and other crazies out there now if you think it’s not possible.
History teaches us that it’s really, really easy to make the leap from concerned citizens who are also veterans to those that advocate a fascist government run like the military.
Bottom line, if you think any of our laws are wrong – change the law, not a citizen’s obligation and duty to at least try and respect it until it is changed.
The other thing to keep in mind also is our right to vote. If you have an elected official that you think is violating our freedoms by supporting laws or certain political party agendas then vote the sucker out of office. But in the meantime, abide our laws but speak out against any law that you think is bogus until you can get it changed.
I can uderstand the Oath Keepers anger at what’s happened to America. Our politicans are directly responsible for the mess we’re in. Ideologically, this country is finished. Intolerance, greed, arrogance and hypocracy have brought America to its knees. Its impossible for this country to unite under one banner which means, no problems will be solved. Big business sold this country out years ago, by exporting our techology to third world countries to increase profits for the rich. Wall street profits while the working class is dismantled and 25 million are out of work or under employed. I’m not sure what the objectives of the Oath Keepers are. If you took any stand against the government,your organization would be crushed with overwhelming force regardless of intent. In ten years, China will own us-It already holds a trillin in US Treasury bonds and could bring our economy down tommorow if it chose to do so.
